المستخلص: التسامح من المصطلحات الحديثة نسبياً في القانون الدولي، وهو جوهر الديمقراطية، والتسامح ثقافة مجتمعية انتقلت من دوائر الأخلاق إلى دائرة الإلزام في القانونين الدولي والداخلي اللذين أوجبا المساواة بين أبناء البشر، حيث منعا التمييز العنصري والقومي والديني والطائفي والإثني. فالتسامح يتطلب التعامل مع من نشترك معه برباط أقوي من حدة الخلاف، دون الإيمان بما هو عليه. ويقتضي التسامح بأن على البشر احترام بعضهم لبعض بكل ما تتسم به معتقداتهم وثقافاتهم ولغاتهم من تنوع. وإذا كان القانون الدولي قد أقر التسامح للطرف الآخر عندما لا يصدر منه فعل مخالف للقانون، فإن الإسلام أقر التسامح، وإن خالف الطرف الآخر أحكام الشرع الإسلامي، واعتدى على حقوق الغير، فقد حث الإسلام المسلمين على التحلي بالمغفرة والرحمة والعفو، وهذا يعني أن دائرة التسامح في الإسلام، أوسع بكثير من دائرة التسامح في القانون الدولي وقد تناول البحث مفهوم التسامح، وثقافة التسامح، ودورهما في البناء الديمقراطي، كما تضمن البحث دراسة محددات تطبيق ثقافة التسامح، ودور المجتمع والدولة في ترسيخها، وانتهى البحث إلى خاتمة تناولت أهم المقترحات.\

Tolerance of relatively recent in terms of international law. The essence of democracy and social tolerance culture moved from the Department of morality to the Department of compulsion in international and domestic law, which imposition equality between human beings, and to prevent racial discrimination, national and religious, sectarian and ethnic. Tolerance requires dealing with those who share with him a stronger bond of the dispute, without faith in the way he is. Tolerance requires that people respect each other in all its beliefs, culture and language diversity. If international law has recognized tolerance of the other party when he makes not actually against the law, the Islam tolerance acknowledged that the other party violates the provisions of Islamic law and attacked the rights of others. Islam has urged Muslims to forgiveness and mercy and pardon. This means that the Department of tolerance in Islam much wider circle of tolerance in international law. The discussion dealt with the concept of tolerance, and a culture of intolerance, and its role in democratic construction, and research has included the study of the determinants of the application of a culture of tolerance, and the role of society and the state in the consolidation, and the search is over to dealt with the most important conclusion of the proposals.
