يتناول هذا البحث مفهوم الرقابة الشرعية من حيث: مفهومها، والأساس الذي تستند إليه في قيامها بالمهام الموكولة إليها، أهمية وجودها في المصارف الإسلامية كصمام أمان لضمان تطبيق الأحكام الشرعية في المعاملات المالية، وأهم المسميات التي تطلق على هذه الهيئة. كما تعرض البحث لبيان مجالات عمل هيئة الرقابة الشرعية التنفيذية (الرقابة الوقائية والعلاجية والتكميلية)، مع ذكر نماذج تطبيقية لها، وأخيرا تمت مناقشة العوائق التي تعتري تطبيق الهيئة لمهامها وسبل تجاوز هذه العوائق. شمل البحث التعريفات اللغوية والفقهية والقانونية للمفاهيم ذات العلاقة، كما شمل مناقشة لبعض المسائل الفقهية كبيع المرابحة للآمر بالشراء، بيع العينة، التورق. \
The subject of this research is The Islamic Shari'a control on the Islamic banks as views and application. It is defined as The Islamic Shari'a control on the Islamic banks starting from its concept besides the origins based on performing the supported missions delegated to it. In addition to its importance and presence at the Islamic Banks as a safe guard to give Islamic comprehensive guarantee in the financial transactions along with names used for this legal commission. The research deals with discussions of the Islamic Shari'a elements as well as mentioning the applied models forms of the executive control commission operations( ) (Integrated, recovery and preventive). Finally, the obstacles have been discussed which caused delay of the commission application for its missions and the techniques used to overcome them. The research also includes the definitions of legal, Islamic judiciary and linguist terminologies for the concepts related to The Islamic Shari'a. Moreover, it includes discussions for some of Islamic judiciary (Feqh) like gaining profit (Murabah) for purchase order, sample sale and through financial documents.
