|a انقسمت آراء الفقهاء في مسألة القول بالمساهمة السلبية أو بطريق الامتناع فمنهم من رفض القول بوجود مساهمة سلبية وفقا لمبدأ الاستعارة المطلقة، حيث يشترط أن يكون فعل الشريك بالمساعدة إيجابيا، ومنهم من ذهب إلى القول بوجود المساهمة السلبية وفقا لمبدأ الاستعارة النسبية بين الفاعل والشريك بالمساعدة، فلا يشترط أن يكون فعل الاشتراك إيجابيا وهو محور هذا البحث، وذلك باستعراض أهم الآراء الفقهية والنصوص القانونية، وكذا أحكام المحاكم متوصلا بذلك لموقف المشرع الجزائري من المساهمة السلبية بكل صورها
