الهدف من البحث هو إبراز أثر التفكير الإبداعي في استنباط النوازل الفقهية, إذ من المعروف أن المجتهد قائم مقام النبي صلى الله عليه وسلم, ولذا يجب على المتصدي للنازلة أن يكون مؤهلاً, وقد ذكر العلماء شروطا عدة يجب توافرها في المجتهد, وأفاض الأصوليون في الحديث عن تلك الشروط وأهميتها للفقيه. وإذا استكملت تلك الشروط في الفقيه فإنها تمنحه الملكة الفقهية, التي تزيده ذكاء في عقله, وإضاءة في فكره, وتجعله قادراً على الإبداع والعطاء والتأليف, وتصوير النازلة تصويراً دقيقاً. ومن هذا المنطلق فقد تحدثت عن أهم خطوات دراسة النازلة, وهي: تصوير المسألة والإحاطة التامة بها, ومعرفة جميع أبعادها وظروفها وأصولها وفروعها, وتاريخ نشأتها, لأهيمة ذلك وأثره في بيان الأحكام, ولا يستطيع الفقيه أن يعطي حكماً دقيقاً للمسألة إلا بعد التصوير الواضح, لأن الحكم على الشيء فرع عن تصوره. وفي هذا الصدد عرضت نماذج فقهية تطبيقية في بيان أثر التفكير الإبداعي في استنباط النوازل الفقهية.
