المستخلص: هدفت الدراسة إلى مناقشة موضوع بعنوان الجوانب الإجرائية لمسطرة التعرض في نظام التحفيظ العقاري الجديد من خلال التعرف على تطور الاجتهاد القضائي المغربي. وسعت إلى إبراز أوجه ومظاهر خصوصية مسطرة التعرض باعتباره دعوى استحقاقية تستقل بأحكام خاصة تختلف عن تلك المعمول بها في إطار القواعد العامة. وتكونت الدراسة من مبحثين، ناقش المبحث الأول خصوصيات إجراءات التعرض خلال المرحلة الإدارية للتحفيظ، والتي انقسمت إلى فقرتين، تناولت الفقرة الأولى الإجراءات المرتبطة بموضوع التعرض، وكشفت الفقرة الثانية عن الإجراءات المرتبطة بمسطرة التعرض. وأوضح المبحث الثاني خصوصيات إجراءات التعرض خلال المرحلة القضائية للتحفيظ، وشملت فقرتين، سلطت الفقرة الأولى الضوء على الإجراءات المرتبطة بتحضير الملف بعد إحالته على المحكمة المختصة. وتطرقت الفقرة الثانية إلى الإجراءات المرتبطة بدراسة الملف من المحكمة المختصة. وأكدت النتائج أن المشرع المغربي حاول إيجاد مجموعة من المقتضيات الجديدة التي من شأنها تنظيم نزاعات التحفيظ العقاري في مجال التعرضات بما يساهم في حماية نظام الملكية.

The study aimed to discuss the subject entitled "Executive aspects of the exposure procedure in the new law under the real property protection regime by identifying the development of the discretion of Moroccan jurisprudence". The study sought to highlight the features and aspects of the specificities of the exposure procedure as a maturity lawsuit, which is subjected to special provisions that differ from those used provisions in the framework of the general rules. The study consisted of two topics. The first part discussed the specificities of exposure procedures during the administrative stage of law under the real property protection regime, which were divided into two paragraphs. The first paragraph dealt with the procedures related to the subject of exposure. The second paragraph revealed the procedures related to the exposure procedure. On the other hand, the second topic highlighted the specificities of the exposure procedures during the judicial stage of law under the real property protection regime. It included two paragraphs. The first paragraph highlighted the procedures associated with the preparation of the file after being submitted to the Court of competent jurisdiction. The second paragraph tackled the procedures related to studying the file by the Court of competent jurisdiction. The results confirmed that the Moroccan legislator tried to find a set of new requirements that would regulate the disputes of the law under the real property protection regime in the field of exposure, thus contributing to the protection of the property system.
