المستخلص: هدف المقال إلى التعرف على القضاء الدستوري كطريق نحو الديمقراطية من خلال دراسة في التجارب الدستورية المقارنة، وتكون المقال من عدة عناصر، تناول العنصر الأول مفهوم القضاء الدستوري. وناقش العنصر الثاني تعريف الديمقراطية. ثم انتقل العنصر الثالث إلى قراءة في أهمية القضاء الدستوري وتطبيقاته. وقراءة في التجارب القضائية المقارنة. وتطرق العنصر الرابع إلى الحاجة إلى القضاء الدستوري في النظام الدستوري الجزائري. وأختتم المقال مؤكدا على أن تجارب القضاء الدستوري الرائدة منها والفتية، تعكس حقيقة وأهمية الدور القضائي في بناء وترسيخ الشرعية الدستورية والديمقراطية السياسية والعدالة القانونية، والأمن والسلم الاجتماعيين، وأشارت إلى أن صدق المواطنة وروح الانتماء السياسي والدستوري يجعل الباحث متحمسا وشغوفا لرؤية عالمنا العربي يتوجه نحو إصلاحات صادقة وهادفة تنتهي برفع الغبار عن نظمنا وتشريعاتنا التي غالبا ما يسودها الالتباس وتنتهي بطموحاتنا وآمالنا إلى الانتكاس، وتحرير قضائنا من شتى أشكال التسخير السياسي، وأثبت المقال أن جهود المجتمع المدني والنضالات النقابية والمهنية مع المتغيرات الإقليمية والدولية أفرزت دستورا نموذجيا هو دستور 2011، الذي انتقلت فيه الحماية الدستورية من نظام الغرفة الدستورية إلى نظام المجلس الدستوري، وصولا إلى نظام المحكمة الدستورية، والذي وإن كان يحتاج إلى معالجات بنيوية ووظيفية فهو بداية لمسارات مستقبلية.

The article aims to identify the constitutional judiciary as a path towards the democracy through a study in the comparative constitutional experiments. The article is composed of several elements. The first element dealt with the concept of the constitutional justice. The second element discussed the definition of democracy. The third element dealt with the importance of reading the constitutional judiciary and its applications, as well as reading the comparative judiciary experiences. The fourth element dealt with the need for the constitutional judiciary in the Algerian constitutional system. The research concluded that the experiences of the constitutional judiciary, whether the pioneering ones or the new ones, reflect the reality and the importance of the judiciary role in building and consolidating the constitutional legitimacy, the political democracy, the legal justice, the security and the peace of the society. It pointed out that the citizenship sincerity and the spirit of the political and the constitutional affiliation make the researcher enthusiastic and eager to see our Arab world move toward a real and a purposeful improvement ending in removing the dust from our systems and legislations, which are often dominated by the confusion. This resulted in the relapse of our ambition, and getting rid of any judiciary of the various forms of the political authority. The article proved that the civil society efforts, the Trade union and the professional struggles along with the regional and the international changes, produced a model constitution which is the Constitution of 2011, in which the constitutional protection moved from the Constitutional Chamber to the Constitutional Court system. This system is considered a beginning of the future trends, even if it needs the structural and the functional treatments. .
