يعتبر القضاء من أبرز المهام وأعظم الوظائف التي تحفظ استقرار المجتمع ومنعة الامة وهو الصورة الماثلة لتطبيق أحكام الشريعة الإسلامية في الواقع المعاصر، ونظرا لشدة خطره وبالغ اثره كان من الولايات العامة التي تناط برأس الدولة، وقد تولى النبي صلى الله عليه وسلم هذا المنصب بنفسه، واناب عنه غيره وارسل قضاته في الامصار، ووليه الخلفاء والولاة من بعده عليه السلام واعتنوا به اشد العناية، ولهم في ذلك رسائل معروفة ووصايا معلومة أرست نظاما قضائيا متميزا بين الانظمة لا تزال الامم تستهدي به. ونلحظ من رسول الله عناية فائقة بالقضاء وتهيئة القضاة وأختيارهم، ولذا احببت ان اسلط الضوء في هذا البحث على أهمية أقضية النبي من خلال بيان طبيعتها وأدلة حجيتها الشرعية والقضائية، إضافة إلى محاولة النظر في شخوص وشخصيات قضاة النبي، وأن أفيد من ذلك في ترسم ملامح شخصية القاضي المسلم التي تمثلها قضاة الاسلام من الصحابة ومن تبعهم مبينا اصولها التي استندت اليها من خلال المبادئ والقواعد والإشارات المبثوثة في ثنايا اقضية النبي ومن خلال اختياره لقضاته. \
Judiciary system is considered as one of the most significant duties and objectives that ensures the stability and safety of society and nation. It is a contemporary standing form of applying the rules of the Shari'ah. It is due to the high importance and effect of this position which supposed to be fulfilled and supervised by the head of the state; we find that the Prophet (p.b.uh) himself practiced it, appointed and sent judges to the Islamic districts. The Caliphs after the Prophet (p.b.u.h) were in charge of this position and paid great attention to it. This was done by a group of charts which were the bases of the Islamic Judicial system which is still well known to all nations. The Prophet's (p.b.uh) patronage of the judicial system can be easily noticed from the great attention he paid for the selection and qualification of judges. Therefore, it is our intention in this research to spot light on the importance, nature and legal evidence of the judgments of the Prophet (p.b.u.h), and on his judges and their characteristics. This is in order to reach a clear and sound view about the image of Muslim judges which was embodied in the Companions and their followers in the light of the principles, indications and rules found in the judgments and the selection of the judges of the Prophet (p.b.u.h). \
