لاشك أن الرشوة جريمة بشعة لكونها فعلاً منحرفاً أخلاقياً وقيمياً حيث تؤدي إلى فساد الأخلق وتخلف المجتمعات، كما تؤدي إلى ترجيح المصالح الخاصة على العامة والثراء بلا سبب مشروع وغير ذلك، لذا فقد حرمتها الشريعة الإسلامية واعتبرتها جريمة موجبة للطرد من رحمه الله وهو ما ذهبت إليه القوانين الوضعية وإن كانت هذه القوانين لم ترق إلى سمو الشريعة الإسلامية وعظمتها.
Undoutly bribery is a hideous, stark crime since it is an utterly immoral and deviant act that causes the wreck of values and embodies source of all cruelty and decline that effects in a society. Bribery makes private interests rather than the public interest the ultimate aim of the civil service. It also perpetuates illegal accumulation of wealth. Hence, bribery is a sinful prohibited act in Islamic Sharia that deserves expulsion from Allah's mercy. Secular laws and codes, though lack the spiritual dimension in prohibition, treat bribery in similar way The theme of this three- section paper is tackled thus: Section I: Definition of bribery linguistically and as a legal term and the legal decree of this act among Muslim jurists and scholars of contemporary laws. Section II: What constitute the crime of bribery according to the Islamic legislation and anti- bribery acts in Sudan Penal Cond, 1991 in comparison with contemporary secular codes. Section III: The anti- bribery punishment prescribed by Muslim jurists in comparison with relevant secular codes.
