برزت أهمية بيان حقيقة العاقلة حديثا كما برزت قديماً وبخاصة مع ظهور بعض المؤسسات العامة والخاصة التي من شأنها أن تعمل على إعانة الجاني في دفع دية القتل الخطأ، وصيانة حقوق المجني عليهم وذويهم في ذلك، ولذا جاءت هذه الدراسة لبيان القول الفصل في حقيقة العاقلة وبيان بعض تطبيقاتها المعاصرة. وقد تناولت هذه الدراسة موضوع العاقلة حقيقتها وتطبيقاتها المعاصرة باسلوب المنهج الاستقرائي والمنهج الوصفي التحليلي من خلال المقارنة بين المذاهب والأقوال؛ فعمد الباحث إلى استقراء موضوعاتها من مصادرها ومراجعها الأساسية ثم قام ببيانها وتفصيلها وذكر أدلتها ومناقشتها ليصل بذلك إلى الراجح. ومن أبرز ما توصلت إليه هذه الدراسة: أن حقيقة العاقلة يقصد بها: فهم الفقهاء لماهية العاقلة وتكييف أحكامها تبعا لذلك الفهم، ومعرفة الأصول التي فرع عليها الفقهاء أحكام العاقلة. وأن كلمة العاقلة لها مدلولان لغوي وشرعي خلاصته النصرة والإعانة والغرم ودفع الدية، وأنها كلمة متسعة تشمل العصبة الذكور وغيرهم، وأن كل من يقوم بدور النصرة له اسم العاقلة، وأن الأصل أن تتحمل العصبة الذكور الدية، ولكن يمكن ترك أمر تحمل الدية في القتل الخطأ إلى مقتضيات الزمان واختلاف الظروف والأحوال، بحيث يبتكر أهل كل زمان ومكان ما يناسبهم من صور جديدة مستقلة تقوم مقام العصبة في تحمل الدية، وأن من أبرز الصور والتطبيقات المعاصرة للعاقلة: التأمين التعاوني والضمان الاجتماعي، والنقابات المهنية.
