يتناول هذا البحث التطبيقات الفقهية، للفظ الخاص من كتاب إحكام الأحكام لابن دقيق العيد، حيث يعد كتاب الإحكام من الكتب المهمة المعتنية بالجانب التطبيقي لأصول الفقه، والمحتوي على الكثير من الفوائد الفقهية والأصولية واللغوية، والإمام ابن دقيق العيد من الأمة المجددين لهذا العلم؛ فقد غلب على هذا الإمام الفذ الجانب التطبيقي للأصول، من خلال استنباط الأحكام من النصوص الشرعية، بناء على القواعد والمسائل الأصولية على منهج المتكلمين، وتميزه في جانب تقرير القواعد الأصولية في كثير من المواطن، مما جعل لكتابه قيمة علمية كبيرة في شروح الأحاديث، وفي كتب التطبيق الفقهي. وقد خلصت في هذه الدراسة إلى أن للإمام ابن دقيق العيد منهجاً أصولياً عاماً، وقد تمثل في تقرير القواعد والمسائل الأصولية، وتحقيق القول فيها، وذكر الراجح، والتطبيق الفقهي عليها، وأن للإمام عناية خاصة بالمقاصد الشرعية، والبعد عن الجدل الأصولي، وتميز منهجه الأصولي التطبيقي في البحث بالدقة، والموضوعية، وترجيح الآراء الفقهية وفقا لتطبيق القواعد الأصولية، كما أن للإمام منهجاً أصولياً خاصاً فقد تفرد في بعض المسائل الأصولية، كتقريره أن السياق طريق إلى بيان المجملات، وتعيين المحتملات وتنزيل الكلام على المقصود منها.
This research discusses the Jurisprudential Applications for the Special Word from Ihkam Al Ahkam Book for Ibn Daqiq Al Eid, where Al Ihkam book is considered one of the important books which took the practical side of Jurisprudence in a deep manner. The book also includes a lot of the Jurisprudential, Fundamentalist and Lingual uses. Imam Ibn Daqiq is considered one of the renovated Imams for this science, as he gave the practical side of Jurisprudence a special attention through deriving the provisions from the religious texts, depending on the fundamentalist rules and issues on scholastics method. He is also distinguished in the area of reporting the fundamentalist rules in several fields, which gave his book a high scientific value, especially in Hadith explanations and jurisprudential application books. In this study, the researcher concluded that Imam Ibn Daqiq Al Eid has a general fundamentalist approach, represents in reporting the fundamentalist rules and issues, applying it, mentioning the preponderant, and its jurisprudential application. Al Imam showed a special attention in the legitimate purposes, and the dimension for jurisprudence. His fundamentalist practical approach has distinguished in its accurate research, objectiveness and considering the jurisprudential views through applying the fundamentalist rules. Also, Al Imam has a special fundamentalist approach, in which he is distinguished in some of the fundamentalist issues, such as his believe that the context is a way to explain the precise, identifying the prospective and referring the speech to its meaning.
