|e هدف البحث إلى التعرف على الطبيعة القانونية للقرارات الصادرة عن الهيئات المهنية من خلال دراسة قضائية فقهية. وتناول البحث اختلاف الأراء الفقهية حول الطبيعة القانونية للنقابات المهنية. وأستعرض قرارات الهيئات المهنية. وأرتكز البحث على مطلبين. أوضح المطلب الأول تطور الاجتهاد القضائي من خلال موقف القضاء المقارن، والموقف القضائي المغربي. وناقش المطلب الثاني تضارب الأراء الفقهية. حيث ركز على الفقه المقارن والفقه المغربي. وكشف البحث عن الطبيعة القانونية للقرارات الصادرة عن هيئة المحامين. وأبرز موقف القضاء الإداري من القرارات الصادرة عن الهيئات الأخرى. وتوصل البحث إلى أن اختلاف كل من الفقه والقضاء الإداريين حول طبيعة القرارات الصادرة عن الهيئات المهنية بين من يعتبرها قرارات إدارية باستخدام وسائل القانون العام، وبين من يعتبرها إحداها إدارية والأخرى قضائية. كما أشار البحث إلى أن الخلاف قد وقع خاصة في المغرب بين الفقه والقضاء المغربي بخصوص هيئة المحامين حول مدي اعتبار قرارتها إدارية قضائية أم خاصة، خصوصا وأن المشروع قد أفرد لقرارات هذه الهيئة مسطرة خاصة للطعن فيها شبيهة بمسطرة الطعن في الأحكام القضائية، الاستئناف والنقض. مما أدي إلي صعوبة تحديد طبيعتها، ومن ثم وجود أحكام متعارضة بشأن طبيعتها فتارة تعتبرها قضائية وأخري إدارية. ويرجع هذا إلي غموض المشروع فكان علية عندما نص على المسطرة الخاصة للطعن في قرارات المحامين أن يحدد طبيعة هذه القرارات في كونها إدارية، وقضائية أو خاصة. كُتب هذا المستخلص من قِبل دار المنظومة 2018
|f The aim of the research is to identify the legal nature of decisions issued by professional bodies through a juristic judicial study. The study dealt with the difference of jurisprudential views on the legal nature of professional syndicates. It reviewed the decisions of professional bodies. The research is based on two requirements. The first requirement explained the development of jurisprudence through the position of the comparative judiciary and the Moroccan judicial position. The second demand discussed the second demand the conflicting juristic views. Where it focused on comparative jurisprudence and Moroccan jurisprudence. The research revealed the legal nature of the decisions issued by the Lawyers Association. It highlighted the position of the administrative judiciary of decisions issued by other bodies. The research found that the differences between the jurisprudence and administrative judiciary on the nature of decisions issued by professional bodies between those who consider them as administrative decisions and those who consider them as judiciary using the means of public law. The study also pointed out that the disagreement has occurred especially in Morocco between the jurisprudence and the Moroccan judiciary regarding the lawyers' body on the extent to which its decision is considered judicial or private, especially since the draft has set out a special procedure for the decrees of this authority for appeal similar to the challenge procedure in the judiciary judgments, appeal and cassation . Which made it difficult to determine their nature, and therefore the existence of conflicting provisions on the nature as they are sometimes considered judicial and another time as administrative. This is due to the ambiguity of the draft as what was provided in the procedure for challenging the decisions of the lawyers to determine the nature of these decisions in their being administrative, judicial or private..
