حسب ما أدلت به الجمعية العامة للأمم المتحدة : " يجب أن نبذل قصار جهودنا لتحرير البشرية جمعاء، قبل أي شيء آخر نحرر أبناءنا وأحفادنا من خطر العيش على كوكب أفسدته الأنظمة البشرية على نحو لا رجعة فيه، ولم تعد موارده تكفي لإشباع احتياجاتهم"؛ فإننا نعيش على وقع مشكلة بيئية تواجه حاضر البشرية وتهدد مستقبلها، والناجمة عن عجز الإنسان في تحقيق التوازن بين الأعمال اللازمة لإشباع حاجاته المتسارعة التطّور وبين المحافظة على بيئة سليمة خالية من الخلل والعطب. لعل ما تعانيه البيئة من تعطل لأنظمتها المرهقة، جعل قضية حماية البيئة مشكلة حضارية في الاتجاه والممارسة والفكر، مما أظهر تعدد وتنوع في الإجراءات المتخذة لحمايتها نظرا لتحسس جميع أنحاء المعمورة بالخطر الآني والمستقبلي الذي يحدق بها، وهذا ما أسفر عن بوادر اهتمام بقضية البيئة توجت بعدد من المؤتمرات الإقليمية والدولية والمعاهدات، التي تمخضت عنها اتفاقيات وخطط عمل لمواجهة هذه القضية، وبهذا أرست أسس متينة تشدّ توجه الدول إلى ضرورة تخصيص الآليات اللازمة وحشد قوى دفع عازمة على ضمان الحق في بيئة سليمة. من هذا المنطلق جاءت هذه الورقة لرصد الحق في بيئة نظيفة من أطروحة التولد إلى التحوّل، تدّرجا إلى متطلبات هذا الحق وآلياته وقوى التحريك في إشارة إلى دور الدولة الجزائرية في مجال إرساء الحق في بيئة نظيفة.
According to what the general league of the United Nation (UN) said: “ We have to make our effort to free entire humanity before anything else, we free our children from the danger of living in a planet spoiled by human systems in unprecedented way, and its resources are no more enough to satisfy their needs”; so we are facing an environmental problem which faces the present of humanity and threatens our future, and which are resulted from the weakness of human being to achieve the necessary works which satisfy its needs that are rapidly developing on one hand and to preserve a safe environment without damage or cleft. the exosling system that the environment is suffering from, made the issue of protecting the environment a civilizational problem in its attitude and practice and thought, which showed avariety of measures taken to protect the environment in regard to the vulnerability of the whole word of the present and future danger which threatens it, and all this contributed to an interest of an environment with many meeting and conferences which led to many agreements and plans to rehabilitate this issue , therefore it established a strong basis which attract the attitudes of the states of the necessacity of putting the appropriate mechanisms and devoting of a strong will to preserve a safe environment . from this base this document came to beholde the right in a clean environment from the thesis of reproduction to the transformation to revendications to this right and its mechanisms and the power of moving an indication of the role of the algerian state of establishing the in a clean environment.
