This thesis deals with "The Rule of Islamic Law in Using Prohibited Materials in the Pharmaceutical Industry". Science in the modern age discovered sources of medicines and ways of treatment that were not known before. Some of these pharmaceutical industries contain impure or prohibited materials from the point of view of Islamic law. To the importance of knowing the Islamic rule in pharmaceutical industry, I addressed this issue: The researcher has mentioned the importance of this subject, the reasons for its choice, previous studies, her approach in the thesis writing and thesis plan, as follows: An introduction: it showed the interest of Islam in lives and the health of the body and this is what appears in many of the teachings of Islam as it cares the health of the soul and the body. Also I have explained that permissibility is the general rule in medication as it fulfills one of the aims of the Islamic Law namely keeping oneself. The thesis has been divided into three chapters: Chapter One showed that some of those unclean fragments like pork, urine and other impurities in the pharmaceutical industry, change in industry and do not remain the same and that is what jurists call استحالة (Istihala). So, if these materials changed in their features, they will be permitted to use in treatment with the requirement of complete change. Some of these materials do not change in industry and remain impure and thus cannot be used in the pharmaceutical industry except with permissions and conditions and in forefront necessity, its use should not be exaggerated, the lack of alternatives and that the recipe should be given by a trustworthy doctor. Chapter Two is about the rule of using natural materials in anesthesia, industrial substances extracted from them that are used in pharmaceutical industry, and synthetic drugs of tranquilizers, sedatives and stimulants. I have also showed the rule of using anesthetic materials in terms of purity and impurity and the rule of using anesthetic materials in case of necessity. Besides, I mentioned alcohol use in pharmaceutical industry and the rule of alcohol in terms of purity and impurity. Chapter Three demonstrates the uses of toxins in the medical field and the sources of animal, plant and chemical toxins. I have stated the rule of using toxins and reported permissible alternatives of this medication that contain unclean and prohibited materials like poison and anesthetic materials. That these things are pure in themselves, banned in use and permissible in therapeutics according to the conditions mentioned above. Muslim scholars still exert efforts to find alternatives permissible for pharmaceutical industries. Until these alternatives exist, the rule of pharmaceutical manufacturing products containing impure and unclean follow the rule of necessity and need. The thesis concluded by stating rules concerning the effects of drugs on sensory effects. Finally, there are the most important results and sources and references that the researcher consulted writing the thesis. At last, Praise be to Allah, Lord of the worlds and peace and blessings on the Holy Prophet Mohammed (Peace be upon him) and his family and companions. |
