إن دراسة (حديث الأحكام) من الدروس المهمة في استنباط الأحكام الشرعية لدى الفقهاء وعليه المعول في مبانيهم, وتعد الكتابة في هذا الموضوع, بان نأخذ الأحاديث المختصة بموضوع معين ونستلخص منه ما ينفع من الأحكام, تعد من الدراسات الحديثة, وقد كان موضوعي ( الرجوع عن الشهادة ) من هذا القبيل وكانت النتائج فيه كالآتي: 1- جعل الفقهاء من خلال متابعتهم للروايات أن الشاهد يكون ضامنا للحق المالي ان رجع عن شهادته وباتفاق المذاهب الإسلامية بعد إصدار الحكم. 2- فرق الفقهاء من حيث الحكم وذلك في: أن كان الرجوع قبل الحكم طرحت شهادته ولا تقبل لا في الأول ولا في الثاني لعدم صدقه وعدم العلم بأنه صادق في الشهادة الأولى أم الثانية وأما إذا كان بعد صدور الحكم من قبل القاضي فيكون الشاهد ضامنا للحق المتراجع عنه. 3- اعتبروا الرجوع عن شهادته بمثابة التوبة, فان كانت العين باقية ردت, وان لم تكن باقية ضمن بمقدار ما رجع. 4- أظهرت الروايات حكم الشاهد الراجع عن شهادته في الزنا بضرب الحد واغرم الدية مع الوهم ومع التعمد القتل ويغرم بقية الشهود ديته إلى أهله. 5- أما روايات الرجوع بالطلاق فقد توافرت على ضمان الراجع عن شهادته ضمان الصداق للزوج الثاني. 6- وأما رجوع الشهود عن السرقة, فقد جاء الحكم مشابها للزنا والطلاق بضمان الشاهد الدية كاملة أن كانا أصلا الشاهدين قد تراجعا عن شهادتهما والنصف أن تراجع احدهما. وقد كانت هناك مساجلات بين الفقهاء في اختلاف مبانيهم في محاكات الروايات اعرضنا عنها لخروج البحث عن مساره الحديثي الاستدلالي الفقهي. هذا أهم ما وقفت عليه في هذا المبحث المتواضع ارجوا به رضاء ربي وإبراز تلك الأحكام المستفادة من الروايات ثانية. وقل اعملوا فسيرى الله عملكم ورسوله والمؤمنون والحمد لله رب العالمين وصلى الله على محمد واله الطيبين الطاهرين.
