يعد البحث في أحكام التنفيذ على المتجر في القانون السوري ذا أهمية لا يمكن إغفالها بعد أن نظم المشرع السوري في قانون التجارة رقم 33 لعام 2007 أحكام المتجر بشكل مفصل فيما يتعلق بتعريفه وبيان عناصره وتحديد طبيعته القانونية وإحداث سجل للمتاجر، وكذلك التصرفات الواردة عليه ولا سيما البيع والإيجار والرهن والتأمين والحجز الاحتياطي وكذلك التنفيذي. كما أن إخضاع المشرع السوري الحجز التنفيذي على المتجر وبيعه تنفيذياً لأحكام حجز العقارات وبيعها تنفيذياً والمنصوص عليها في قانون أصول المحاكمات رقم 84 لعام 1954 وتعديلاته، أظهر الكثير من السلبيات والتعقيدات في بيع المتجر تنفيذياً. وعليه: تناولنا في هذا البحث دراسة مفهوم المتجر وبيان عناصره ومن ثم عرضنا أحكام تسجيل المتجر وحجزه تنفيذياً في المبحث الأول، وفي المبحث الثاني تناولنا أحكام بيع المتجر بالمزاد في القانون السوري، وختمنا هذه الدراسة بالنتائج والتي توصلنا إليها من خلال البحث وبتوصيات تتعلق بضرورة تدخل المشرع السوري لتعديل أحكام تسجيل المتجر في سجل المتاجر والتنفيذ عليه ومبررات هذا التدخل.

Based on that, we dealt with in this research study of the concept of the store and a statement of its elements and then offered the provisions of the registration of the store and booked an executive in the first section , and in the second part, we dealt with the provisions of the sale Store auctions in Syrian law , and we ended the study results and we have reached through research and recommendations regarding the need for intervention Syrian legislator to amend the provisions of the registration in the register of the store shops and force him and the justification for such an intervention.
