|f The Waqf (endowment) is one of the tributaries of development and plays a major role in supporting the national effort to develop the economy and consolidate noble values in society, through cultural and educational institutions and charitable projects. The past decades have seen a growing interest in the Waqf (endowment), considering it to be the third sector of the economy. This research addressed the problem of: Shari'ah controls and legal frameworks governing the Waqf in Algeria. After discussing the conceptual framework of the Waqf, its pillars and its invalidators, the historical course in Algeria from the late Ottoman era to the present and the legislative system that regulates it, were explored. The result was that concern for the endowment (Waqf) did not rise to the desired level. Moreover, its areas of development are still traditional, whilst the investment has not been pushed strongly in respect to the human capital, like it has been in relation to education and training, the establishment of research centers and university institutions. The needs always remains urgent to modernize the laws related to the Wqf (endowment) and to develop and stimulate it.\nThis abstract translated by Dar AlMandumah Inc. 2018

|d Le « wakf » est l’un des pierres angulaires dans le développement ,où il joue un rôle important pour soutenir l’effort national dans le développement économique et pour consolider les valeurs nobles dans la société ,a travers les institutions culturelles ,éducatives et les projetsde bienfaisance. Il présentait un grand intérêt pendant les dernières décennies puisqu’il présente le troisième secteur dans l’économie. Cet article essai de résoudre la problématique suivante: La charia et le cadre juridique qui régissent la dotation (Al Wakf) en Algérie.\nAprès avoir traité le cadre conceptuel ,un étalement historique sur le Wakf en Algérie depuis la fin del’époque ottomane jusqu'à nos jours ainsi que système législatif qui le gère montrent que le Wakf n’est pas le centre d’intérêt dans le domaine de développement et l’investissement dans le potentiel humain comme l’éducation et la recherche dans les centres scientifiques et universitaires .\nLa rénovation du système législatif pour propulser d’avantage le système Wakf s’avère nécessaire.

|a يعتبر الوقف أحد روافد التنمية، ويضطلع بدور كبير في معاضدة المجهود الوطني لتنمية الاقتصاد وترسيخ القيم النبيلة في المجتمع، من خلال المؤسسات الثقافية والتعليمية والمشاريع الخيرية، وقد شهدت العقود الماضية اهتماما متزايدا بالوقف باعتباره القطاع الثالث في الاقتصاد. وقد عالج هذا البحث إشكالية مفادها: الضوابط الشرعية والأطر القانونية التي تحكم الوقف في الجزائر. بعد تناول الإطار المفاهيمي للوقف وأركانه و مبطلاته ،تم التطرق إلى مساره التاريخي في الجزائر منذ أواخر العهد العثماني إلى اليوم، والمنظومة التشريعية التي تسيره، فكانت النتيجة أن الاهتمام بالوقف لم يرق إلى المستوى المرجو منه، كما أن مجالات تنميته ما زالت تقليدية ولم يقتحم الاستثمار في رأس المال البشري بقوة كالتعليم والتدريب وإنشاء المراكز البحثية والمؤسسات الجامعية، وتبقى الحاجة ملحة دائما لتحديث القوانين المتعلقة بالوقف وضرورة تنميته وتفعيله.
