The Gaza Port topic was brought back to the fore as a condition by the resistance for a ceasefire with the Israeli occupation in the recent 2014 war. According to the present paper, it should not have raised it in this framework, since the issue represents a Palestinian right in accordance with the Oslo and Sharm Al- Sheikh agreements. The situation is discussed in terms of the historical and legal backgrounds, as well as how the Palestinian- Israeli accords had tackled the matter. Moreover, the investigation looks into the conditions of reviving the port problem in such a context, the chances of construction, employment, necessary steps and scenarios of success.
