المستخلص: هدف البحث إلى الكشف عن صلاة الغائب على الموتى والشهداء في ضوء الأدلة والقواعد الشرعية. واستخدم البحث المنهج الاستقصائي الاستدلالي لتوضيح الراجح من أقوال أهل العلم في صلاة الغائب على الموتى والشهداء، وحكم الصلاة على الميت وشروطها، وحكم الصلاة على الميت الغائب، وحكم الصلاة على الشهيد الغائب.
وتوصلت النتائج إلى أن صلاة الغائب هي الصلاة على الميت الذي غابت جثته عن المكان المراد الصلاة عليه فيه. ثبت عن الرسول صلى الله عليه وسلم أنه صلى على النجاشي صلاة الغائب، وقد وردت روايات عديدة في ذلك. الصلاة على الميت غير الشهيد فرض على الكفاية عند جمهور الفقهاء، ويرى المالكية أنها سنة، وهو قول ضعيف، لمخالفته الكتاب والسنة والإجماع. صلاة الغائب مشروعة في حق المسلم الذي يموت في بلد آخر إذا لم يصل عليه. إن ما يفعله بعض الناس من أنه كل ليلة يصلى على جميع من مات من المسلمين يعد بدعة. كما أن صلاة الغائب على الشهداء غير مشروعة، ولا يصلى على الشهيد الحاضر. وأوصى البحث بضرورة الرجوع إلى الأصل في العبادات، فلا ينبغي للمسلم أن يتعبد لله تعالى إلا بما شرع.

The research aimed to uncover the absentee funeral prayer on the dead and the martyrs in light of the evidence and the sharia rules. The deductive survey was used to clarify likely the preponderant of the scholars in the absentee funeral prayer on the dead and the martyrs. It discussed the rule of prayer for the dead and its conditions, the rule of prayer for the absent deceased, and the rule of prayer for the absent martyr.
The results reached that the prayer of the absent is prayer on the dead, whose body is absent from the place where it is intended to pray. It is proven that the Prophet (peace and blessings of Allah be upon him) said that he prayed on the Negus of the absentee funeral prayer. Numerous novels have been cited. Prayers for the non-martyr dead is fardu kifayah in the scholars' opinion. Maliki sees that it is a Sunnah, which is a weak saying, for violating the Quran and Sunnah and the unanimity. The prayer of the absent is lawful in the case of a Muslim who dies in another country if he cannot reach it, and what some people do is that every night he prays on all those who have died of Islam is a heresy. As the absentee funeral prayer on the martyrs is unlawful, and does not pray to the martyr whose body is present. The researcher recommended the necessity of referring to the original in the worship. Therefore, the Muslim should not worship Allah except by what He has prescribed.
