We can then understand the dynamics of some distinction precolonial Tunisian institutions. \|d Cet article étudie l’évolution de la situation foncière et juridique d’un henchir public situé à Hammam Sousse au sahel tunisien, il en montre aussi différentes conséquences comme les relations intra habitants d’un côté, et entre eux et l’instrument juridique colonial en matière foncière d’un autre côté. On pourrait ainsi comprendre la dynamique de distinction de quelques institutions tunisiennes précoloniales.
