In consideration of the unity of history, language, aspirations and destiny in both the Gulf and the Maghreb regions, and given the transformations, interdependence and integration taking place at the international level, as well as the challenges facing the Gulf and Maghreb countries and peoples in the political, economic and social fields, these countries have worked to crystallize their integration efforts within two regional organizations, the first of which brought together the Arab countries in the Gulf and the other, brought together the Maghrebi countries in North Africa. And it is on this basis that I will conduct an analytical and comparative study of the general status of both the GCC and the Maghreb Union in parallel with the GCC Statute and the Treaty establishing the Arab Maghreb Union. This will be addressed in two sections. The focus in the first section, is on the organizational structure of the Gulf Cooperation Council of the Arab States, in general. In the second section, the structure of the Cooperation Council will be compared with those of the Maghreb Union, in terms of institutions, methods of joining and decision-making. This abstract translated by Dar AlMandumah Inc. 2018 بالنظر إلى وحدة التاريخ و اللغة و التطلعات و المصير في كل من منطقتي الخليج و المغرب العربي، و نظرًا لما يحدث من تحولات و ما يتم من ترابط و تكامل على الصعيد الدولي، و ما تواجه الدول و الشعوب الخليجية والمغاربية من تحديات في الميادين السياسية و الإقتصادية و الإجتماعية، فقد عملت هذه الدول على بلورة جهودها التكاملية في منظمتين إقليميتين جمعت الأولى الدول العربية في الخليج و الثانية الدول المغاربية في شمال إفريقيا، و على هذا الأساس سأقوم بدراسة تحليلية و مقارنة للوضعية العامة لكل من مجلس التعاون و الإتحاد المغاربي بالموازاة مع النظام الأساسي لمجلس التعاون لدول الخليج العربية، و معاهدة إنشاء إتحاد المغرب العربي، في فصلين يتم التركيز في الفصل الأول على الهيكل التنظيمي لمجلس التعاون لدول الخليج العربية بوجه عام، أما في الفصل الثاني سيتم مقارنة بنية مجلس التعاون مع تلك الموجودة في الإتحاد المغاربي، من حيث المؤسسات و طريقة الإنضمام و كيفية إتخاذ القرارات. Le cadre juridique et institutionnel pour l'intégration dans chacun du Conseil de coopération du Golfe et l'Union du Maghreb arabe Une étude comparative Compte tenu de l'unité historique , et la langue commune , les aspirations et la détermination à la fois dans le Golfe et le Maghreb En plus ce qui se passe sur le champ international et régionale au niveau de la corrélation et intégration . les pays du Golf et du Maghreb ont travaillé à développer leurs efforts d'intégration dans les deux organisations régionales premiers pays arabes se sont réunis dans le Golfe et les secondes pays du Maghreb se sont réunie a son tour en Afrique du Nord, et sur cette base je vais présenter en ce résume ce qu on a fait dans l étude comparative et même analytique. Or on a comparé la position générale pour chacun le Conseil de coopération et de l'Union du Maghreb en parallèle avec leurs traites de créations ca veut dire le Statut des pays du Golfe arabe, et le traité instituant l'Union du Maghreb arabe, les deux font l'objet du premier chapitre notamment sur la structure organisationnelle du Conseil de coopération du Golfe, mais dans le deuxième chapitre on a comparé la structure du Conseil de coopération avec celle de l'Union du Maghreb arabe, en termes d'institutions et surtout comment adhérer des nouveaux membres et prendre des décisions de sorte que le chapitre un se concentre sur le cadre institutionnel et juridique pour le Conseil de coopération du Golfe et le Chapitre II: traite le cadre institutionnel et juridique de l'Union du Maghreb arabe Le succès de la coopération et l'intégration régionale entre les Eats se traduit souvent dans une large mesure par le type d'institutions et les dispositifs qui guident ses activités avec l'efficacité de ses décisions . Et en raison des différents besoins de chaque région et les circonstances particulières qui les distinguent. Il est difficile d'extrapoler le modèle des institutions et de l'organisation qui y fonctionne, et il est donc impératif que les pays de chaque bloc régional devraient développer des institutions et des arrangements qui cadrent avec les conditions économiques et sociales, ainsi politiques, et coïncident avec les objectifs communs qui vise à atteindre que ce soit dans les pays du GCC ou UMA . |
