This research approaches one of the exceptional mandatory provisions that apply on some Sharia provisions that seek to treating any kind of embarrassment that they may cause, due to narrowness of some general rules towards some issues that need exceptional treatment. It addresses an issue that happen to most humans, and indispensible to them; it is debt and the provisions, regulations, and documentation it might send, in addition to the treatments and procedures because of the problems of unpayment that may accompany it, besides the need for a wise treatment to combine between reality and legitimacy of dealing with debts and the obligatory nature of debt payment among people. The focus of the study is mainly on the provisions made to treat debt payment issues in general, and in details the treatments in case of hardship, or punishment in use of unpayment, each according to what is suitable to the case. This comes through treatment of hardship case by giving him plenty of time or writing off the debt as giving alms, helping him to pay off his debt and maintaining creditors' rights. Moreover, the focus is put also on studying the provisions an punishments for debtors in case of procrastination, and the strong language needed, and applying hard punishment in case of insistence on procrastinating, such as custody, blacklisting him from traveling, and some see necessity of flogging him, aiming at compelling him to pay off his debts, others' rights, and punishing him for his injustice. In addition, the research approaches the jurisprudent provisions and legal procedures that maintain good transaction between people, and save creditor's rights by selling property of the debtor and paying off his debts.The conclusion illustrates the most important findings and recommendations. I hope it will illuminate the road for those who want to further research this topic which needs more research and innovation in its provisions and regulations, in order to explain the provisions of our Sharia to all human beings for their good to adjust and promote their legislations, and finally I ask Allah His help to me and to others.
يتلخص موضوع البحث في مناقشة حكم من الأحكام الاستثنائية الجبرية التي ترد على بعض الأحكام الشرعية, والتي ترد معالجة لما قد يحدثه من الحرج، لضيق بعض القواعد العامة عن بعض القضايا التي تحتاج لمعالجات استثنائية. وهذا البحث يتناول معالجة قضية تمس غالب البشر, حيث لا غنى لأكثر الناس عنه، وهو (الدين)، ولما يحتاجه من الأحكام والضوابط والتوثيقات، والمعالجات والإجراءات, لما قد يعتريه من مشكلات عدم السداد، والحاجة إلى المعالجة الحكيمة للتوفيق بين واقعية ومشروعية التداين بين الناس، وبين وجوب سداد الدين ومشكلاته. وقد تركزت عناصر الدراسة في هذا البحث على الأحكام التي وضعت معالجة لقضايا سداد الدين بصفة عامة، وعلى التفصيل للمعالجات حال العسر، أو العقوبات حال المطل، كل حسب ما يتناسب وحاله، وذلك بمعالجة أمر المعسر، بإنظاره، والتصدق عليه، مساعدة له في أداء دينه، وحفاظاً لحقوق الدائنين، ثم دراسة الأحكام والعقوبات التي وضعت للمدين حال المطل، وما يلزم في ذلك من تشديد القول عليه، وملازمته إن استدعى ذلك، ثم إنزال العقوبات المشددة عليه إن أبى وأصر على المطل، بحبسه ومنعه من السفر، وحتى يرى البعض ضربه في بعض الأحيان, ليؤدي الدين الذي عليه رداً للحقوق وعقوبةً لظلمه. ثم ما يتبع ذلك من أحكام فقهية وإجراءات قانونية، تحافظ على حسن التعامل بين الناس، وتحفظ حقوق الدائنين، ببيع ماله وسداد دينه. وخاتمة توضح أهم ما توصل إليه البحث من نتائج وتوصيات، أرجو بها أن تنير طريق الذين يمضون بالبحث في هذا الموضوع، الذي يحتاج المزيد من البحث والتجديد في أحكامه وضوابطه، بغية توضيح أحكام شرعنا الحنيف، وعرضه للبشرية عامة، نفعاً لهم في تصويب وترقية تشريعاتهم، والله أسأله التوفيق والسداد لي، ولغيري، وهو أرحم الراحمين.
