هدف البحث الحالي إلى الكشف عن المرجعية الفكرية والأسس القانونية والتشريعية لتعليم وتربية المعاقين في مصر والولايات المتحدة الأمريكية. حيث تناول تقديم رؤية متميزة والمستندة إلى الحضارة الإسلامية والشريعة الإسلامية فيما يتعلق بقضايا المعاقين تعليما وتربية وتأهيلا. كما أشار إلى النموذج الغربي متمثلا في تجربة الولايات المتحدة الأمريكية باعتبارها أبرز نموذج وقائد للعالم الغربي في مقابلة النموذج المصري المستند إلى الحضارة الإسلامية. وإلقاء الضوء على ضرورة الاهتمام بالمعاقين وتعليمهم وتربيتهم وذلك من خلال الجانب التشريعي والفكري والثقافي. والتعرف على بعض المفاهيم والمصطلحات المتعلقة بالإعاقة والمعاقين. وعرض أسباب الإعاقة وأنواعها وخصائصها. والتعرف على حجم الإعاقة في مصر بالإضافة إلى تبصير المعاقين وأولياء أمورهم ومساعدة المعلمين على فهم الأطر القانونية والتشريعية وأحكام قوانين المعاقين المتعلقة بتربيتهم وتعليمهم. واستخدم البحث المنهج الوصفي التحليلي. واستند البحث على المحاور التالية فلسفة تربية وتعليم المعاقين. وأسس ومبادئ تربية وتعليم المعاقين. والأسس القانونية والتشريعية والفلسفية لتربية وتعليم المعاقين في الولايات المتحدة الأمريكية. والأسس الفكرية والثقافية والقانونية لتعليم وتربية المعاقين في جمهورية مصر العربية ومقارنة تحليلية بين التجربة الأمريكية والتجربة المصرية. وتوصلت النتائج إلي تفوق التجربة المصرية على التجربة الأمريكية فيما يتعلق بالمرجعية الفكرية والحضارية والعقائدية للأطر التشريعية والقانونية لتعليم المعاقين فالمعوقون في المجتمع الإسلامي لهم الحقوق التي لا تقل عن حقوق الأشخاص العاديين، وهناك غياب لأهداف مستقبلية لتعليم وتدريب وتأهيل المعاقين في مصر. وعدم الاهتمام بأسر المعاقين من قبل مؤسسات رعاية المعاقين. وأوصي البحث بضرورة إعداد القيادات المتخصصة بتعليم المعاقين. وتحديث طرق التدريس للمعاقين.كُتب هذا المستخلص من قِبل دار المنظومة 2018
The current research aims to uncover the intellectual resource and the legal foundations of the education and the learning of the disabled people in Egypt and the United States of America. It addressed the presentation of a distinct vision based on the Islamic civilization and the Islamic law related to the issues of people with disabilities in light of the education, the parenting and the qualification. It also referred to the Western model as the experience of the United States as the most prominent model and leader of the Western world in comparison to the Egyptian model based on the Islamic civilization, and to highlight the need to care for the disabled and their education and parenting through the legislative, the intellectual and the cultural aspect, and to identify some concepts and terms related to the disability and the disabled people, and presenting the causes, the types and the characteristics of the disabilities, and to identify the extent of the disability in Egypt in addition to make the disabled people and their parents aware and help the teachers to understand the legal and legitimate frameworks and the law's provisions of the disabled people related to their parenting and education. The research used the descriptive analytical method. The research was based on the following axes of the education philosophy of the disabled people, the bases and the principles of the parenting and the education of the disabled people, the legal and the legitimate and the philosophical foundations of the parenting and the education of the disabled people in the United States, the intellectual, cultural and the legal principles for the parenting and education of the disabled people in the Arab Republic of Egypt and an analytical comparison between the American experience and the Egyptian experience. The results showed that the Egyptian experience is superior compared to the American experience in terms of the intellectual, the cultural and the ideological reference of the legitimate and the legal frameworks for the education of the disabled people. The disabled people in the Islamic society have rights that are no less than the rights of the ordinary people and there are no future goals for the education, the training and the rehabilitation of the disabled people in Egypt, and the lack of interest of families of the disabled people by the institutions for the care of the disabled people.
