أقل الجمع هو أقل عدد عدد يطلق عليه لفظ الجمع بحيث تبرأ ذمة المكلف أن أدى ما يصدق عليه هذا اللفظ. وقد اختلف الأصوليون في مفهومه، وليس الخلاف في معناه في ضم شيء وإنما الخلاف في الجمع هل أقله اثنان أم ثلاثة على الأقوال المشهورة عنهما وإن ردت عنهم أقوال أخرى لكنها مجازات بالاتفاق. أن الجمع في حقيقته ينقسم إلى جمع قلة هو ثلاثة أو اثنين إلى عشرة، وجمع كثرة من أحد عشر فصاعداً غير أن الأصوليون لم يفرقوا بينهما بل جعلوه واحد وجعلوا أقله اثنتان أو ثلاثة. احتج كل طرف بأدلة عرضناها في ثنايا البحث مع الردود عليها إن وجد، ومن ثم بينت ثمرة الخلاف في الفروع الفقهية المتولدة من الاختلاف وفائدة ذلك هو براءة ذمة المكلف من عهدة التكليف بمجرد إثباته ما يدل عليه أقل لفظ الجمع اثنان أو ثلاثة على الخلاف المذكور.
