L’extension de la responsabilité de l’auteur directe du dommage écologique A la lumière de la loi n° 42-2014 concernant la protection de l’environnement L’augmentation rapide de la population, et le développement technologi¬que énorme à tous les niveaux à avoir un impact négatif sur l’écosystéme, l’impact négatif que cela a conduit à une trouble de l’équilibre écologique, et a abouti à la pollution de l’environnement. D’ici les problèmes environnementaux principalement liés à l’existence humaine. La doctrine et la juridiction ont essayés afin d’adapter les règles générales de droit pour l’extension de la responsabilité civile de la pollution de l’environnement, qui ont réussis d’un part et ont échoué dans l’autre part, en raison de la spécificité des dommages écologiques. Qui a finalement abouti au législateur koweitien à adopter une nouvelle loi intégré. Un chapitre a été mis pour traiter la responsabilité civile pour dommage écologique et l’indemnisation, et il nous a semblé que le législateur a abandonné la faute en cas de dommage directement faite. De ce point de cette étude portera sur la nature de la directe, qui appelle l’enraciner, d’attaquer la notion et les conditions pour appliquer tous cela au domaine de l’environnement. Ensuite d’étudier les dispositions nouvelles de la responsabilité civile, tirées par le législateur, pour renforcer la protection civile de l’environnement. This study addresses one of the important issues raised by the transport of international air passengers. It addresses the extent of the liability of the international air carrier of the psychological damage to the passengers. The importance of this subject depends on the relativity of the passenger and his safety which is the most important factor. This requires strict liability of the transport in general and the international carrier in particular. However, the emphasis in the International air carrier’s liability may affect the continuity of performing this vital service, particularly when taking into consideration the damage incurred in the event of accidents involving the air transport facility, and the number of passengers in addition to the high value of the plane. Reconciling the above two factors, this intensifies the responsibility of the international air carrier towards the physical and psychological safety of the passengers. Considering the responsibility of the international air carrier in regards to the psychological damage, I believe that the international air carrier is to compensate the affected passenger whether the effect is resulted from a physical damage or it is just a psychological damage. أدت الزيادة السريعة في السكان، وما صاحبها من تطور تكنولوجي هائل على جميع الأصعدة، إلى التأثير سلباً على المنظومة البيئية؛ هذا التأثير السلبي أدى إلى الإخلال بالتوازن البيئي، ونتج عنه ما يسمى بالتلوث البيئي، ومن هنا ارتبطت المشكلات البيئية بشكل أساسي بوجود الإنسان. وقد حاول الكثير من رجال القانون والقضاء تطويع القواعد العامة لتقرير المسؤولية عن التلوث البيئي، التي أفلحت في جانب وأخفقت في جانب آخر، بسبب خصوصية الأضرار البيئية. مما أدى في نهاية المطاف بالمشرع الكويتي لإصدار قانون جديد متكامل، خصصت أحد أبوابه لمعالجة المسؤولية المدنية للأضرار البيئية والتعويض عنها، وبدا لنا فيه أن المشرع تخلى عن ركن الخطأ عندما يحدث الضرر مباشرة. ومن هذا المنطلق سوف تتناول هذه الدراسة ماهية المباشرة، وهو ما يستدعى تأصيلها وبيان مفهومها وشروطها في المجال البيئي، ثم نعرض لأحكام المسؤولية المستجدة التي رسمها المشرع لتعزيز الحماية المدنية للبيئة. |
