الحمد لله والصلاة والسلام على رسول الله وآله وصحبه أما بعد: فقد عمدت إلى تناول موضوع مهم لا غنى لبشر عنه، ففيه بقاء الجنس البشري بأسره ومن خلاله يتم إلتقاء فطري لا محيد عنه بين الذكر والأنثى فالنكاح ضرورة بشرية وحاجة فطرية، وتناولت من خلال البحث أهميته ولا سيما في هذا الزمان الذي كثرت فيه الفتن والصوارف، وحاولت إبراز منهج القرآن الكريم في عرض التشريعات الاجتماعية، وتلبية المطالب الفطرية، وعلاج المشكلات التربوية، فجمعت الآيات الآمرة بالنكاح وحاولت استنطاق ما فيها من الدلالات والمفاهيم والمضامين الشرعية، وبينت أهمية النكاح في إعفاف الشباب والفتيات، وأنه السبيل الأمثل لقضاء الوطر الحلال ، وقسمت البحث إلى مبحثين اساسين : الأول: الآيات الآمرة بالنكاح، ومن خلاله عرفت النكاح، وأقوال المفسرين في معناه، وحكمه، والنهي عن عضل النساء، وحكم الولي، وفوائد النكاح وثمراته، وحكم نكاح الزناة والمشركين. الثاني: الآيات الآمرة بالاستعفاف عند عدم النكاح، ومن خلاله عرفت العفة، وأقوال المفسرين في معناها، والوسائل الشرعية المعينة على الاستعفاف، والنهي عن الإيلاء من النساء، أو جعل المرأة معلقة، ثم فوائد وثمرات الاستعفاف.
All thanks are due to Allah, and blessing and peace upon Prophet Muhammad and his family and companions. The topic of sexual practice is important for the survival of mankind, and it is both a necessity and an instinct for males and females alike. The present research addresses this sensitive topic at a time when sensation and temptation have increased. The purpose is to show the Quranic instruction in legislating the righteous sexual practice, while satisfying the natural need addressing educational problems related to sexuality. Quran verses about the topic are discussed to reveal their real conceptualization and Sharia purposes, illustrating the social benefits of regulating marital sexuality, which assists in keeping young people's chastity. The topic is divided into two parts: part one deals with Quranic verses about virtuous sexual practice and the definition of NiKaH (marital sex), different opinions of Quran interpreters on the topic, forbidding injustice against women, the status on woman guardian, and finally the benefits of legally organizing sexual practices and the ruling on marrying non-Muslims and adulterers. The second part deals with chastity, giving a definition of the term: including interpreters’ opinion of the term, and discussing the acceptable means of chastity in Islam. The discussion covers other relevant topics: forbidding suspending one's wife and the benefits of chastity for those who cannot afford marriage. Finally. I pray that this effort is accepted by Allah and useful for the Muslims at large, and I pray that the blessings of Allah be upon Prophet Mohammad and his family and companions.
