يعد عقد الإيواء المعلوماتي من أهم العقود الإلكترونية التي ظهرت حديثا بسبب كثرة التعامل بشبكة الإنترنت، ولحداثة العقد فلم ينظم المشرع العراقي هذا العقد بإحكام خاصة ولم يرد له تعريفا معين، على الرغم من صدور قانون التوقيع الإلكتروني والمعاملات الإلكترونية. ويتصف عقد الإيواء المعلوماتي بعدة خصائص أهمها، أنه عقد من العقود التي تبرم عن بعد حيث لا يكون لأطرافه وجود مادي في مجلس العقد وأيضا يعد من العقود التجارية حيث يهدف متعهد الإيواء من تقديم خدمة الإيواء الحصول على الربح. يعد عقد الإيواء المعلوماتي من العقود التي لها طبيعة خاصة الأمر الذي يقتضي السعي لوضع تنظيم لهذه العلاقات وذلك بالاستعانة بالقواعد القانونية العامة ذات الصلة الواردة في التشريعات السارية أو باقتراح استحداث نصوص تشريعية جديدة لمواجهة ما قد يكشف عنه الفراغ التشريعي في هذا الإطار. ولعدم وجود تنظيم قانوني خاص في العراق ينظم العلاقة بين متعهد الإيواء والمستخدم، يثير عقد الإيواء المعلوماتي من الناحية القانونية العديد من التساؤلات، سواء تلك الخاصة بتعريفها أو خصائصها المميزة أو أطرافها أو محلها أو طبيعتها القانونية، أو تلك الخاصة بحقوق والتزامات كل من أطرافها. لذلك سنعالج هذا الموضوع من خلال القواعد التي استقرت عليها التشريعات المقارنة وما استقر عليه الفقه والقضاء في الدول الأخرى.
