المستخلص: تهدف هذه الدراسة إلى تحقيق النتائج التالية:
- استطاع المشرع الجزائري أن يقدم إطاراً قانونياً مقبولاً لجريمة المؤامرة.
- إلا أنه لم يحدد الوسائل التي يمكن أن تتم بها المؤامرة عكس ما ذهبت إليه أغلب التشريعات العربية كالمشرع الأردني والسوري والمصري. كما أنه خلق تناقضاً في العقوبة بين جريمة المؤامرة والجرائم التي يستدعي العقاب عليها قيام المؤامرة فيها، مما يضعنا في إشكالية تطبيق النص العقابي.
- لذلك لابد من التحديد الدقيق وإعادة النظر في عقوبة جريمة المؤامرة. كما يجب على المشرع الجزائري أن يحدد وسائل قيام هذه الجريمة شأنه في ذلك شأن باقي التشريعات العربية.

Cette étude vise à atteindre les résultats suivants:
- Le législateur algérien a été en mesure de fournir un cadre juridique acceptable pour le crime de complot.
- Mais il n'a pas précisé les moyens qui peuvent être faites par le contraire de ce complot adopté par la plupart des législations arabes, tels que le législateur jordanien et syrien et égyptien. Il a également créé une contradiction dans la peine entre le crime de complot et les crimes qui exigent la punition par l'infraction de complot, ce qui nous place dans une application problématique du texte répressif.
- Donc, il doit être précis et de revoir la peine de l'intrigue. Doit également législateur algérien afin de dèterminer les moyens de faire ce crime, comme le reste des législations arabes.

This study aims to achieve the following results:
- Capability of the Algerian legislature to provide an acceptable legal framework for the crime of conspiracy.
- However, it did not specify the means by which the plot could be carried out, in contrary to what most of the Arab legislations, such as the Jordanian, Syrian and Egyptian legislations, have done. It also created a contradiction in the punishment between the crime of conspiracy and crimes that call for punishment by conspiracy, which puts us in the problem of the applying the punitive text.
- Therefore, the exact definition and reconsideration of penalty of the crime of conspiracy is necessary, and the Algerian legislator must also define the means of such a crime, as do the other Arab legislations.
