هذا ملخص للبحث المقدم إلى مجلة كلية العلوم الإسلامية المحكمة. 1- يستدل على عموم اللفظ بقبوله للاستثناء، فإنه إخراج ما لولاه لوجب دخوله في المستثنى منه، فلزم أن يكون كل الأفراد واجبة الاندراج، وهذا هو معنى العموم، كما تقول: جاءني قوم صالحون إلا زيدا. 2- لا خلاف بين علماء الأصول في الفقه الإسلامي في أن التخصيص: قصر العام على بعض أفراده بدليل، غير أنهم يختلفون في صفة ذلك الدليل الذي يتم به التخصيص، فالجمهور لا يشترطون في الدليل الذي يتم به التخصيص: المقارنة، ولا الاستقلال، أما الحنفية: فيشترطون في الدليل الذي يتم به التخصيص أن يكون مستقلا عن جملة العام، مقارنا له في الزمان. 3- الاستثناء عند الفقهاء أعم من مفهومه عند الأصوليين، فعند الفقهاء هو شامل لكل ما يقتضي المغايرة والمخالفة لكلام متقدم، إما بإخراج بعض أفراده كلية، أو بتقييدها بأوصاف وغايات ونحوها. 4- يدخل في الاستثناء التقييد بإلا وأخواتها، والشرط، والصفة، والغاية ...، وعلى هذا فينبغي أن لا يخلط بين اصطلاحات كل علم، وهذا ما يقرر لنا أن فهم كلام أهل كل علم إنما يكون على ضوء المصطلحات التي تواضعوا عليها. 5- الذي يظهر لي أن ما تناوله الأصوليون من بحث في المسألة اشتراط الاتصال في الاستقاء ليس له داع؛ لأن أصل الخلاف إنما هو واقع في الاستثناء بمشيئة الله، وهو كما تقدم لا يعتبر استثناء على اصطلاح الأصوليين، وإنما أدخلت هذه المسألة وحكي فيها الخلاف لما وقع من خلط بين البابين، أعني باب الاستثناء، وباب الشرط؛ لأن الاستثناء بالمشيئة هو تعليق بشرط. 6- نقل عامة الأصوليين من الشافعية والحنابلة والمالكية الاتفاق على اشتراط عدم استغراق المستثنى للمستثنى منه، والا بطل الاستثناء. غير أن للحنفية في ذلك تفصيلا، وهو أن الاستغراق إن كان بلفظ المستثنى منه أو ما يساويه في المفهوم الذهني المجرد فلا يجوز، أما إن كان بغير لفظ المستثنى منه بأن يكون أخص من لفظ المستثنى منه بحسب المفهوم الذهني المجرد، فيصح الاستثناء. وعلى هذا فينبغي أن يستوثق الباحث فيما يعزوه للمذهب، وذلك بأن يرجع إلى كتب أصحاب كل مذهب؛ لأنهم أعلم الناس به، ولا يغتر بما يحكى في كتب غير المذهب الذي يريد عزو قوله إليه. 7- تناول الأصوليون في علم الأصول مباحث لغوية لما لها من أثر في عملية الاجتهاد وكان للأصوليين في هذه المباحث زيادات وإضافات جليلة، لا توجد عند أهل العربية أنفسهم. 8- الاستثناء دليل من أدلة التخصيص المتصلة، وهو مذهب الجمهور من المالكية والشافعية والحنابلة والظاهرية كما اختاره جملة من الحنفية، كابن الهمام وابن عبد الشكور. 9- قاعدة الاستثناء من النفي إثبات ومن الإثبات نفي متجهة، وعلى اعتبارها جماهير الأصوليين. 10- الجماهير من العلماء يعتبرون الاستثناء من أدلة التخصيص المتصلة، وأما أكثر الحنفية وإمام الحرمين والغزالي، ومن وافقهم، فالاستثناء والتخصيص أمران متباينان عندهم، لذا فقد جعلوا لهذا التباين آثارا تتمثل في الفروق التي تتمشى في مذهبهم بين التخصيص والاستثناء. 11- الاستثناءات المتعددة التي خلت عن حرف العطف ولم يستغرق الأخير الأول، بل نقص عنه، أن كل استثناء يرجع إلى ما قبله، وهو مذهب الجمهور. 12- الاستثناء إذا وقع عقب الجمل المتعاطفة، فإنه يعود إلى جميع الجمل، وهذا ما ذهب إليه جمهور الأصوليين، وهو أقرب إلى الصواب وأمتن في الحجة، فليس بعض الجمل أولى من بعض، كما أن حرف العطف يوجب الجمع والتشريك، كألفاظ الجموع. ففي ختام هذا البحث أسأل الله تعالى أن يكتب التوفيق والسداد والنجاح في ما تضمنه من تعليقات وتعقيبات وترجيحات، وما كان فيه من سهو وخطأ فاسأل الله تعالى أن يغفر لي ويتوب علي إنه هو التواب الرحيم.
