المستخلص: The article aimed at revealing the nature of the "jurisprudence of vulnerability". It also pointed out that the Prophet (PBUH) has said that the religion has some people who will engage in it and turning away from it, and that people go back to the time they were weak strangers in the era of the beginning of Islam. The article also pointed out that this vulnerability will be partial, the Muslims are strong because of being supported with their right, the strong and clear argument, this vulnerability doesn't last forever, but it is temporary. The nation face the vulnerability as a result of delinquency, whether in the religious side and its care or in the life side and the preparation of power in it. The article based on the following axes: the meaning of the jurisprudence of vulnerability, indications of jurisprudence of vulnerability, and also applications of the jurisprudence of vulnerability and its controls. The article was concluded by referring to a collection of references and applications of the jurisprudence of vulnerability, including the message of Ibn Taymiyyah to the people of Mardin, that is also written in the name of "a message to the people of necessity" and answers of Tosolly to the questions of Prince Abd el Kader Algerian, at the time of his jihad against the French, in this book he dealt with many of the conditions of vulnerability.

هدف المقال إلى الكشف عن ماهية فقه الاستضعاف. كما أوضح أن النبي (ص) قد أخبر ان للدين إقبالا وإدبارا، وأنه يأتي على الناس زمان يعودون فيه كما كانوا في صدر الإسلام غرباء مستضعفين.واشار المقال أيضا إلى ان هذا الاستضعاف سيكون جزئي، فإن المسلمين أقوياء غالبون بما معهم من الحق، وقوة الحجة، ووضوح المحجة، وهذا الاستضعاف ليس دائما، وإنما هو وقتي، يمر بالأمة نتيجة لتقصيرها، إما في جانب الدين ورعايته أو في جانب الدنيا وإعداد القوة فيها. واستند المقال إلى المحاور التالية: المقصود بفقه الاستضعاف، وشواهد فقه الاستضعاف، وأيضا تطبيقات لفقه الاستضعاف وضوابطه. واختتم المقال بالإشارة إلى مجموعة من المراجع والتطبيقات لفقه الاستضعاف منها رسالة ابن تيمية لأهل ماردين والمطبوعة أيضا باسم رسالة لأهل الضرورات، وأجوبة التسولي عن أسئلة الأمير عبد القادر الجزائري، وقت جهاده للفرنسيين، والتي تناول فيها كثيرا من أحوال الاستضعاف.
