تبحث هذه الدراسة ضوابط العمل بفقه الموازنات. وفقه الموازنات يعني الموازنة بين المصالح والمفاسد إذا تعارضتا بحيث نعرف متي نقدم درء المفسدة على جلب المصلحة، ومتى تغتفر المفسدة من اجل المصلحة. ومن أسباب اختيار الموضوع الإسهام في الدعوة للرجوع إلى الفقه الإسلامي وجعله أساسا للتشريع في البلاد الإسلامية بتقديم دراسة تتناول ضوابط العمل بفقه، الموازنات بأسلوب سهل. ومن أهم الأهداف سد الفراغ في مكتبة الفقه الإسلامي بإيجاد دراسة متخصصة تبحث الجوانب المختلفة في ضوابط العمل بفقه الموازنات بتجميع شتات مسائله المنثورة في كتب الفقه. وتكمن أهمية الموضوع في أن فقه الموازنات يعد من الموضوعات المهمة وبمعرفته وفهمه وانتشاره تحل الكثير من المعضلات التي تواجه المجتمع المسلم لا سيما في مجال القضايا الفقهية المعاصرة. تبدأ مشكلة الدراسة بتحديد مفهوم فقه الموازنة ومن ثم الانتقال إلى كيفية تبصير الناس للعمل به. اتبعت الدراسة المنهج الوثائقي التاريخي بشكل عام ومعتمدة على الأسلوب الاستقرائي ألاستنتاجي في بعض الحالات. ومن أهم النتائج، حاجة الأمة إلى فقه الموازنة لمعالجة الكثير من القضايا الفقهية المعاصرة. ومن التوصيات أن يهتم الدعاة إلى الله بهذا الفقه وتعلمه وتعليمه لما فيه من النفع الكبير لاختيار الأصلح ودرء الأفسد. ثم زيل البحث بفهرس المصادر والمراجع.
This study examines the controls of working by jurisprudence of balance which means balancing the pros and cons if they conflicted so we know when we offer ward off evil to bring interest, and when to forgive corruption for the sake of interest. Among the reasons for choosing the topic is to contribute in calling to return to the Islamic jurisprudence and make it the basis for legislation in Islamic countries to provide a study on the controls of working by jurisprudence of balance in an easy manner. One of the main goals is to fill the vacuum in the library of Islamic jurisprudence by finding specialized study looking at different aspects of the controls of working by jurisprudence of balance by assembling its scattered issues in the books of fiqh. The importance of the subject lies in that jurisprudence of balance is one of the important issues. A lot of problems facing the Muslim community can be solved by its knowledge, understanding and spreading especially in the Held of contemporary issues of jurisprudence. The problem of the study begins with identifying the concept of jurisprudence of balance and then move on to enlighten people how to work with it. the study followed the historical documentary method in general, and based on inductive deductive method in some cases. Among the most important results, the need of the nation to the jurisprudence of balance to address many issues of contemporary jurisprudence. Among the recommendations, preachers to God must be concerned with this doctrine and its learning and teaching because of its great benefit for the selection of the fittest and the prevention of corrupt.
