|a رغم ما تقوم به أطراف البعثات الدبلوماسية في بناء وتوطيد العلاقات الدولية لدى كل من الدول الوافدة والموفدة، إلا أن لهذه الفئة صعوبات قد تعترضها في تأدية مهامها في فترات النزاع المسلح غير الدولي بما يتنافى مع الأعراف و القوانين الدولية المتضمنة حماية لهذه الفئة كإتفاقية فيينا للعلاقات الدبلوماسية لعام ١٩٦١م والبرتوكول الإضافي الثاني لعام ١٩٧٧م، ولا تحظى البعثات الدبلوماسية بالحماية اللازمة إلا بعد أن يتوفر لكل من المبعوث بشخصه والأطراف العاملة تحته و لكل المقرات سواء أكانت تلك التي يزاولون فيها نشاطهم أو تلك التي تأويهم الحماية والحصانة اللازمة، ولا يتحقق هذا الأخير إلا بعد أن يتم احترام مبدأ التمييز الواجب التطبيق في النزاعات المسلحة غير الدولية القائم على التفرقة مابين المدنيين والعسكريين فحظر الهجوم على أفراد البعثة الدبلوماسية يعد من قبيل الحظر الناتج عن كونهم غير مقاتلين وما بين الأعيان المدنية وتلك الموجهة للأهداف العسكرية أو الحربية و احترام حق الامتداد الإقليمي للدولة الموفدة

|f In spite of what the diplomatic mission parties undertake in terms of building and strengthening international relations among both the sending and receiving states, this group nevertheless can face difficulties related to the undertaking of their tasks during periods of non-international armed conflict which run contrary to the international customs and laws, which include within them the protection of this group (i.e. diplomats). That is like the Vienna Convention of 1961 related to diplomatic relations and the second additional protocol of 1977. The diplomatic missions do not enjoy the necessary protection until the diplomatic himself and those working under him in addition to all of the headquarters or bases of work, whether they were those they undertook their activities in or those which shelter them, were all provided with the necessary protection and immunity. This last can only be achieved once the principle of the obligatory distinction application in respect to non-international armed conflicts has been respected, which is established upon the differentiation between civilians and combatants. As such, the prohibition of attacking diplomatic mission members is a prohibition resulting from them being non-combatants and what is between civilian targets and those which have been targeted due to military or war objectives, in addition to respecting the territorial right of the delegating state. \nThis abstract translated by Dar AlMandumah Inc. 2018
