مشكلة البحث: يتطور الفكر الإنساني وتتطور معه المفاهيم المتعلقة بالحريات العامة وتتعدد كذلك ضوابط حرية الرأي والتعبير ولا يخلو التاريخ الإنساني من المعارك باسم الحرية التي تعد من القيم الإنسانية النبيلة، تتلخص مشكلة البحث في السؤال التالي: هل يمكن وضع دراسة مقارنة في تطور الفكر الإنساني بين الفكر الإسلامي والفكر الغربي فيما يتعلق بحرية الرأي والتعبير. وأهم تساؤلات: 1- ما حدود حرية الرأي والتعبير في الفكر الإسلامي. 2- وهل توجد ضوابط لحرية الرأي والتعبير في الفكر الغربي 3- هل يمكن وضع مقارنة بين حدود حرية الرأي والتعبير ما بين الفكر الإسلامي والنظم الغربية المعاصرة. وأهم النتائج: 1- تقييد الحرية وإطلاقها والحدود الفاصلة بين الحرية المطلقة والحرية المنضبطة بأخلاقيات وقيم اجتماعية تختلف باختلاف الأفكار والعقائد والمفاهيم من مجتمع لآخر ومن دولة لأخرى. 2- تنطق حرية التعبير في الفكر الغربي من أخلاقيات الشعب وقيمه وأعرافه وإيمانه العميق بالحرية المطلقة التي تتلخص فيأن الانسان يفعل ما يريد ولا نجد قيودا تحد من هذه الحرية. 3- كفل الإسلام حرية العقيدة (لا إكراه في الدين) وتقف وثيقة المدينة المنورة شاهدا عبر التاريخ على حرية الرأي وحرمة المدينة وحرمة الحياة والمال وهي فتح جديد في الحياة السياسية فأصبحت مدينة الرسول صلى الله عليه وسلم وما وراءها حرما لأهلها وقد كفل البند المتعلق باليهود على نص " لليهود دينهم" فحرية المعتقدات هي أصل حرية الرأي. أهم التوصيات: 1- الحرية أساس الحياة ما لم تصطدم بحقوق الآخر وهي الأصل في الحياة ولكن لابد من ضبطها وتنظيمها. 2- لابد من تفعيل القوانين حتى يتمكن المواطن من التمتع الحقيقي بجميع الحقوق التي تنص عليها الدساتير. 3- ضرورة توسيع هامش الحريات حتى ينطلق الانسان للمهام المكلف بها.
Research problem: The humanitarian point of views develop and so the concepts relating to public liberties do, measures of opinion and expression opinion vary, the humanitarian history is enriched with battles in the name of freedom which is considered a noble humanitarian value. The research problem is briefed in the following question: Is it possible to set a comparative study about the humanitarian views development between the Islamic and western views in the context of expression & opinion liberty? Important Queries: 1/ what are the limits of expression and opinion freedom in the Islamic believes? 2/ Are there any limits for opinion and expression freedom in the Western believes? 3/ Is it possible to set a comparison between the limits of opinion and expression freedom between the Islamic and recent Western systems? Important Results: 1/ Restriction and provision of freedom and the separating limits between the absolute freedom and freedom regulated by conducts, and social values that varies according to difference in thoughts, believes and concepts from one community to another and one state to another. 2/ Freedom of expression in western views is originated from conducts, values of the public and deep belief of the public and absolute freedom which is briefed in that the person do what he likes without his freedom being hindered by obstacles. 3/The Islam provided the freedom of belief (Religion is not enforced) the document of the lighting Medina is a witness through history of opinion liberty, sanctions of Prophet Mohamed's Medina became a mosque for its residents. The article related to Jewish provided the context of (Jewish have their own religion). The freedom of believes is the origin of opinion freedom. Important Recommendations: 1/ Freedom is the base of life as long as other rights are preserved. It is the origin in life but it should regulated and adjusted.. 2/ Laws should be activated so that all the rights specified by constitutions will actually be provided for every person. It is necessary to extend the margin of liberties so that the person can carry all duties assigned to him.
