التَّصَرُفُ في الوَقفِ عَلَى غَيرِ مَا أَرَادَهُ الوَاقِفِ -مَعَ إمكَانِيَّةِ الاستَفَادَةِ مِنهُ كَمَا أرَادَ - أَمرٌ لَا يَقُولُ أَحَدٌ بِجَوَازِهِ, وَيَزدَادُ حُرمَةً إِذَا عُطِّلَ؛ وَلَكِنَّ المُلَاحَظَ فِي الآوِنَةِ الأَخِيرَةِ عَدَمُ إدرَاكِ النَّاسِ حُكمَ ذَلِكَ, وَإنَّمَا يَسُوقُهُم إلى ذَلِكَ رَغبَتُهُم فِي فِعلِ الخَيرِ بِدُونِ مَعرِفَةٍ لِفِقهِ الوَقفِ, فَأَصبَحُوا لَا يَعُونَ حَقِيقَةَ الوَقفِ وَخُطُورَةَ التَّعَدِّي عَلَيهِ, وَنَاقَشَ هَذَا البَحثُ الوَقفَ إذَا تَعَطِّلَت مَنَافِعُهُ, وَصِيَانَتَهُ وَإصلَاحَهُ وَعِمَارَتَهُ, وَحُكمَ بَيعِهِ أَو استِبدَالِهِ إذَا تَعَطَّلَت مَنَافِعُهُ, وَحُكمَ ذَلِكَ إذَا لَم تَتَعَطَّل مَنَافِعُهُ وَبَدَلُهُ خَيرٌ مِنهُ نَفعَاً وَثَمَرَةً, مَعَ ذِكِرِ تَفرِيعَاتِ ذَلِكَ, وَتَطبِيقَاتٍ مُعَاصِرَةٍ, وَأَمثِلَةٍ مُتَجَدِّدَةٍ.
