Praise be to Allah for all His blessings as is appropriate to His grace, majesty and glory and peace and blessings be upon our master, Muhammad, the pure and most perfect, and on all his Companions and family To proceed, This paper is arranged into an introduction, three chapters and a conclusion. The introduction The introduction states the importance of the topic and its purpose. Chapter one Chapter one provides the definition of qiyas (analogical reasoning), its grounds, integrals and conditions. The first chapter is broken up into three sections: i- Definition of qiyas. ii- The validity of qiyas as a source of law. iii- The integrals and conditions of qiyas. Chapter two Chapter two discusses hudud (prescribed legal penalties) and kaffarat (expia¬tions) and the scholarly opinions determining them through the exercise of qiyas. The chapter is divided into two sections: i- A definition of hudud and kaffarat. ii- Opinions of Islamic legal theorists on the determination of hudud and kaf-farat through the exercise of qiyas. Chapter three Chapter three discusses the effect of the difference of opinions between Is-lamic legal theorists in determining hudud and kaffarat through the exercise of qiyas on Islamic jurisprudence. Conclusion The conclusion sets forth the most important results reached. I ask Allah the Almighty to grant us sincerity and bless us with understanding in religion and peace and blessings be upon our master Muhammad who was sent as a mercy to the worlds and upon his family and Companions.
