تعالج هذه المقالة موضوع نظرية الظروف الاستثنائية من خلال نشأتها والظروف التاريخية المصاحبة لهذه النشأة،كما تتطرف لتعريفاتها المختلفة من الناحية القضائية والفقهية ،وكذا دراسة النصوص الدستورية الجزائرية التي تطبقها الدولة في حالة تعرضها إلى ظروف استثنائية والتي تهدف من خلالها إلى حفظ النظام العام وضمان سير المرافق العامة بانتظام واطراد. This article dealt with the subject of the theory of exceptional circumstances through its inception and conditions in the historical associated with this upbringing, as radicalized different definitions of judicial and jurisprudential point of view, as well as the study of the Algerian constitutional provisions applied by the State in the case of exposure to exceptional circumstances and which aim to maintain public order and ensure the functioning of facilities public regularly and steadily. Cet article traite de l'objet de la théorie des circonstances exceptionnelles par le biais de sa création et les conditions dans l'historique associé à cette éducation, comme radicalisé des définitions différentes du point de vue judiciaire et jurisprudentielle, ainsi que l'étude des dispositions constitutionnelles algériens appliquée par l'Etat dans le cas d'exposition à des circonstances exceptionnelles et qui visent à maintenir l'ordre public et d'assurer le fonctionnement des installations publique régulièrement et de façon constante |
