المستخلص: Under the application of the theory of exceptional circumstances, the legislature granted to management broad powers to cope with the circumstances which aims to protect public order and the public interest in the community; in which , management may use extraordinary means may be harmful to public freedoms, which guaranteed protection constitutions and international conventions, especially in the case of declaration of a state the siege and the state of emergency, and the exceptional case; therefore, we have tried in this research to show the most effective safeguards that contribute to the protection of individuals’ public freedoms from arbitrary administration in the case of application of the theory of exceptional circumstances statement. The most important guarantee for the protection of freedoms in this case is the responsibility of management for all of its work, and subject to judicial scrutiny, which stands on the side of the protection of these freedoms, in addition to the conditions that is imposed by the administrative management in order to apply the theory of exceptional circumstances.

في ظل تطبيق نظرية الظروف الاستثنائية فإن المشرع منح للإدارة صلاحيات واسعة لمواجهة تلك الظروف بما يهدف لحماية النظام العام وتحقيق المصلحة العامة في المجتمع، لذلك قد تستخدم الإدارة وسائل غير عادية قد تضر بالحريات العامة، التي ضمنت حمايتها الدساتير والمواثيق الدولية، خاصة في حالة إعلان حالة الحصار وحالة الطوارئ، والحالة الاستثنائية، لذلك حاولنا في هذا البحث بيان أهم الضمانات الفعالة التي تساهم في حماية الحريات العامة للأفراد من تعسف الإدارة في حالة تطبيقها لنظرية الظروف الاستثنائية. وأهم ضمانة لحماية الحريات في هذه الحالة هو مسؤولية الإدارة عن جميع أعمالها ، وخضوعها للرقابة القضائية التي تقف في صف حماية هذه الحريات، بالإضافة إلى الشروط التي فرضها الفقه الإداري على الإدارة حتى تطبق نظرية الظروف الاستثنائية.
