يتمحور موضوع هذه الدراسة حول إشكالية امتلاك القرار ووهم حرية الرأي والتعبير ، الذي تم تقسيمه إلى مبحثين اثنين ، تناول الأول مسألة حرية الرأي والتعبير كتأصيل لحقوق الإنسان من خلال تقسيمه إلى مطلبين اثنين، تم الحديث في المطلب الأول عن أهم محددات حرية الرأي والتعبير ، وانعكاسها على حقوق الإنسان تمثلت تلك المحددات في هاجس الأمن القومي وضعف الثقافة وانعدام الوعي ،فضلاً عن وجود هيمنة القوة القاهرة التي اندرجت تحتها –الهيمنة السياسية والهيمنة الاجتماعية . وتناول المطلب الثاني فأنه تناول ثقافة الصمت كإحدى العوائق إمام حرية الرأي والتعبير، التي شكلت بها الثقافة السائدة اكبر قدر من التبعية وترسيخ ثقافة الصمت. إما المبحث الثاني من هذه الدراسة حرية الرأي بين عولمة حقوق الإنسان والثقافات المحلية ، فاختص المطلب الأول منه بدراسة عولمة حقوق الإنسان التي تجسدت منذ الخليقة ونزول الأديان السماوية ، فضلاً عن الأفكار الإنسانية التي طرحت منذ عهد التنوير على أيدي عدد من الفلاسفة والمفكرين، أما المطلب الثاني فقد تناول الثقافات المحلية وحرية الرأي والتعبير ، إذ تعرض للثقافة المحلية والقيم الاجتماعية ودورها الهام في تطوير وتوعية المجتمع على المستويين الرسمي والشعبي .
