|a نجم عن الاستخدامات المختلفة للتقنيات السلكية والاسلكية الى فتح افاق ضخمة امام تقدم البشرية وازدهارها ،إلا انها كانت مصحوبه بالعديد من المشكلات التي ليس من السهل حلها بصورة فورية ،وتمثلت هذه المشكلات بالأضرار الكهرومغناطيسية وآثارها الضارة على صحة الانسان، وعليه بدت الحاجة ماسة لمواجهة تلك المخاطر، مع الاخذ بعين الاعتبار أن القواعد العامة في قانون المعاملات المدنية الاماراتي تتطلب تغييرا في بعض القواعد القانونية المتعلقة بالمسؤولية المدنية . وقد حاولنا من خلال هذه الدراسة تسليط الاضواء والكشف عن مدى الحاجة إلى إستحداث قواعد قانونية تتلائم مع المخاطر التكنولوجية الحديثة، والطبيعة الخاصه للأضرار الكهرومغناطيسية، وكذلك الامر ببيان مدى الحاجة الى إجراء التعديلات اللازمة في التشريعات الوطنية لتنظيم عمل شركات التقنية السلكية واللاسلكية، بحيث يتم وضع معايير للسلامة والمواصفات الفنية كتدبير احترازي فعال لمنع الاضرار الكهرومغناطيسية للهواتف النقالة.

|b The Legal Protection from the Mobiles Electro-Magnetic damages Due to the usage of the modern means of telecommunications that opened new great horizons with regard to the human development and progress but in the meantime, it was accompanied by so many problems which are not so easy to solve soon, such problems were represented in the electromagnetic damages and its harmful impacts on the human being health. Therefore, there has been a need that necessitate responding to these chronic problems to avoid their damages as indicated taking into consideration the general rules in the law of the civil transactions procedures in the United Arab Emirates ( in the Emirati law) which requires some changes in the legal rules related to the civil responsibility. We try through this study to throw the light on / and explore the need to create new legal rules that comply with the modern technical dangers and the special nature concerning the damages referred to earlier as well as to explain the scope of need to undertake certain amendments required in the national legislations to regulate the working of the telecommunications companies in order to set up and act toward preparing safety criteria and technical specifications as a precautionary measures to avoid the electromagnetic damages of the mobiles strictly speaking
