This paper deals with the role of legislation in the fight against corruption , especially since the corruption that has spread all over the world constitute the biggest obstacle to the development of society , and generates conditions , social and political situations and economic weaken the state and its structure; and then spread corruption and increasing repression and encroachment on personal freedoms. This leads to serious consequences for the individual and society at the same time. The research has come to the set of results , including the following: that corruption has spread in the contemporary world are terrible , and new ways. Corruption has contributed to the decline in public investment efficiency , frequently what is offered to the staff of the Public Service of bribes thereby limiting the financial resources of the state. The research has come to several recommendations , among them the need to return to God and His laws and the application of its provisions , and that the government employment through fair competition , and the need to activate the role of oversight of government institutions , and to be audited periodically
يتناول هذا البحث دور التشريع في محاربة الفساد ، لاسيما وأن الفساد الذى عم العالم في هذا العصر يشكل أكبر عائق أمام تطور المجتمع. ويولد أوضاعا وحالات سياسية واجتماعية واقتصادية تضعف الدولة وكيانها، ومن ثم ينتشر الفساد ويزداد القمع والتعدي على الحريات الشخصية . وهذا يؤدي إلى انعكاسات خطيرة على الفرد والمجتمع في آن واحد. وقد توصل البحث إلى مجموعة من النتائج، نذكر منها : أن الفساد انتشر في العالم المعاصر بصورة مريعة، وبأساليب جديدة. وقد ساهم الفساد في تدني كفاءة الاستثمار العام ، بكثرة ما يقدم لموظفي الخدمة العامة من رشاوى فتحد بذلك من الموارد المالية للدولة. وقد توصل البحث إلى عدة توصيات نذكر منها ضرورة الرجوع إلى الله وتطبيق شرعه وأحكامه، وأن يكون التعيين في الوظائف الحكومية عن طريق المنافسة المشروعة، وضرورة تفعيل دور الرقابة على المؤسسات الحكومية، وأن تكون المراجعة دورية.
