يتناول موضوع هذا البحث الحقوق والحريات في دستور السودان المرتقب، كما نأمل أن يحتوي عليه، مقارنا بالحقوق والحريات في دستور السودان الانتقالي لعام 2005م، وما يحتاج إليه من تكملة حتى تجيء نصوص الدستور المرتقب ملبية لمطلبات شعب السودان في الحرية والديمقراطية والحكم الراشد. تكمن مشكلة البحث في أن تعديل الدساتير ليس بالأمر السهل فهو يحتاج إلى الكثير من الجهد والشفافية والرؤى الثاقبة حتى تحقق الدساتير أهدافها ومراميها. تنبع أهمية البحث من أهمية الحقوق والحريات نفسها التي ينبغي النص والتأكيد عليها من خلال نصوص الدستور. يهدف البحث إلى التركيز على ترقية الحقوق والحريات من خلال مواد الدستور كما يهدف إلى التأكيد على ضرورة النص في الدستور القادم على آليات ووسائل فاعلة يكون من شأنها الحيلولة دون انتهاك الحقوق والحريات المنصوص عليها في الدستور قبل وقوعها، وفي حالة انتهاكها يكون هنالك آليات للمعاقبة تتمتع بما يكفي من الفاعلية والشفافية لردع المنتهكين وتمليك الرأي العام الحقائق بمهنية وتجرد وشفافية. توصل البحث لعدد من النتائج والتوصيات التي تمثل جلها في المقترحات لتعديل الدستور المرتقب والتي تمت معالجتها من خلال البحث.
