The purpose of this research is to define the priorities jurisprudence and its importance in general, and its application to special needs people to perform the Hajj rituals in particular. The research included an introduction in which researcher mentioned the importance of regarding priorities when applying the judgments , four topics dealt with the definition of the priorities jurisprudence, and how it varies according to people, environments and different ages , as well as the definition of special needs people and how Islam take this category into consideration. The study also showed the great impact of application of this type of jurisprudence on special needs people segment in order to facilitate the difficulties facing them in performing this rite and to facilitate its performance in the best way to achieve the wise legislator of this rule and what is consistent with the overall objectives presented in saving the nation religion, its souls, progeny, minds and money in whole and in part. Based on this type of jurisprudence, the study reviewed methods of jurisprudence as the owner of the need has priority over the person who does not need anything the damaged person has priority over the person who have no excuse, \\ Then the study presented a number of jurisprudential applications in Ihram (Consecration), Tawaf (circumambulation of the Kaba), standing on Arafa mountain (Standing by the rocks) proceeding to Muzdalifah and Mina and other Juristic judgments. \\ The study followed the analytical descriptive method depending on the texts of the Holy Quran and the honorable Sunnah,, the sayings of the jurists and the jurisprudential rules from which we derive the Islamic judgment . The study concluded with some results and recommendations, the most important of which is to advise the pilgrims in general and the disabled people in particular with the goals, priorities, the reality, and the purpose of facilitation and lifting the embarrassment. يهدف هذا البحث إلى التعريف بفقه الأولويات وأهميته بصفة عامة، وتطبيقه على ذوي الاحتياجات الخاصة في أداء مناسك الحج بصفة خاصة. واشتمل البحث على مقدمة ذكر فيها الباحث أهمية مراعاة الأولويات عند تطبيق الأحكام. وأربعة مباحث تناولت التعريف بفقه الأولويات، وكيف انه يختلف باختلاف الناس والبيئات واختلاف العصور، وكذلك التعريف بذوي الاحتياجات الخاصة وكيف راعى الإسلام هذه الفئة. ثم بينت الدراسة الأثر الكبير لتطبيق هذا النوع من الفقه على شريحة ذوي الاحتياجات الخاصة وذلك تذليلا للصعاب التي تواجههم عند أدائهم لهذه الشعيرة، وتيسيراً لإقامتها على أحسن وجه بما يحقق مقصد الشارع الحكيم من التشريع، وبما يتفق مع المقاصد الكلية المتمثلة في حفظ دين الأمة ونفوسها ونسلها وعقلها ومالها كلاً وجزءً. وبناءً على هذا النوع من الفقه استعرضت الدراسة طرقا للفتي -كصاحب الحاجة أولى بالتقديم على من لا حاجة له، وصاحب الضرر أولى بالتقديم على من لا عذر له ثم عرضت الدراسة كذلك جملة من التطبيقات الفقهية في الإحرام والطواف والوقوف بعرفه ومزدلفة ومنى إلى غيرها من الأحكام. اتبعت الدراسة المنهج الوصفي التحليلي اعتماداً على نصوص القرآن الكريم والسنة المطهرة، وأقوال العلماء، والقواعد الفقهية التي يستنبط بها الحكم الشرعي. كما خُتمت الدراسة بخاتمة بها بعض النتائج والتوصيات التي من أهمها توعية الحجاج عامة والمعاقين على وجه الخصوص بفقه المقاصد والأولويات وفقه الواقع ومقصد التيسير ورفع الحرج. وتضمنت الخاتمة توجيهات للقائمين على أمر الحجيج في البلدان الإسلامية قاطبة.
