يدور هذا البحث حول نظرية الميزان عند الإمام الشعراني، والتي تقدم رؤية جديدة في فقه الخلاف، وقد حاول الشعراني من خلالها أن يثبت نظريا وتطبيقيا أن جميع أقوال الأئمة المجتهدين –وعلى رأسهم الأئمة الأربعة –ومقلديهم على هدى من ربهم، وأن مذاهبهم كلها إنما هي داخلة في سياج الشريعة، وبالتالي فليس هناك مذهب أو بالشريعة من مذهب آخر، وأن كل مجتهد مصيب، وعلى رأسهم الأئمة الأربعة ومقتيهم، وأن أحكام الشريعة الإسلامية الغراء السمحة جاءت رحمة للعالمين متكاملة في تشريعاتها ملائمة للأقوياء والضعفاء طبقًا لمرتبتي الميزان: التشديد والتخفيف. وأن هاتين المرتبتين ترفعان التناقض بين أدلة الشريعة وأقوال علمائها؛ لأن شرع الله تعالى يجِلُّ عن التناقض، وكذلك بين أقوال الأئمة المجتهدين؛ وذلك لأنه ما من قول من أقوالهم إلا وهو مستند إلى أصل من أصول الشريعة. وهو إما مخفف أو مشدد، وكلاهما ملائم للأمة بما فيها من الأقوياء والضعفاء.
This research is about the Theory of Balance by Imam AlShaarany, which provides new concept in 'Variation Doctrine'. Through it, AlShaarany proved, theoretically and practically, that all the sayings by all hardworking Imams- especially the top four ones- and their follower Imams, are all guidaned by Allah, and all their orientations are within the limits of the Islamic jurisprudence. This is why there is no better orientation than other, and every hardworking Imam of them is considered correct, especially the top four Imams. Through the 'stressed' and the 'justified' ranks of the theory, AlShaarany clearly proved that the permissiveness Islamic jurisprudence is integrated, merciful and suitable for both strong and weak faith types of people. These two ranks removed the conflict arises occasionally between the evidences of Islamic jurisprudence and the statements made by its scientists and hardworking Imams, which is an evidence of lack of conflict in the Islamic jurisprudence. The theory also proved that all the sayings by all Imams are based on one of the basis of the Islamic jurisprudence, in stressed or justified ranks, and proved that both of these ranks are suitable to both strong and weak faith types of people
