|a تحاول الدراسة التعرض الى التعديلات التي مست النظام الأساسي للمحكمة الجنائية الدولية، وكذا وثيقة اركان الجرائم وفقا للمادة 123 من النظام الأساسي للمحكمة الجنائية الدولية، التي تنص على ان يعقد الأمين العام للأمم المتحدة مؤتمر استعراضي للنظر في أي تعديلات للنظام الأساسي بعد بدء نفاذه بسبع سنوات، وهو ما تم من خلال المؤتمر الاستعراضي بكمبالا في جوان 2010 بخصوص صور الركن المادي لجريمة الحرب والواردة في القرار5.RC/Res، والذي تمخض عنه تعديلا للمادة 8 من النظام الاساسي بإضافة الفقرة 2 هـ من المادة 8، وكذا تعديل المادة 8 من وثيقة اركان الجرائم بإضافة الفقرة 2 ه 13 المتعلقة باستخدام السموم أو الأسلحة المسممة، والفقرة 2 ه 14 المتعلقة باستخدام الغازات أو السوائل أو المواد أو الأجهزة المحظورة، وكذا الفقرة 2 ه 15 المتعلقة باستخدام الرصاص المحظور.

|d L'étudier essaie d'exposer les amendements qui ont touché le Statut de la Cour pénale internationale, ainsi que le document des éléments de crimes d'après l'article 123 du Statut de la Cour pénale internationale, qui prévoit que le Secrétaire général de l'organisation des Nations Unies tient une conférence pour l'examen de tout amendement pouvant toucher le Statut après son entrée en vigueur depuis sept ans, et c'est ce qui a été fait à la suite de la Conférence de Kampala en Juin 2010, concernant les images d'élément matériel du crime de guerre qui sont introduites dans la résolution 5.RC/Res, et qui a abouti à un amendement de l'article 8 du Statut en ajoutant le paragraphe 2 e de l'article 8, ainsi que l'amendement le document des éléments de crimes en ajoutant le paragraphe 2 e 13 concernant à l'utilisation des poisons ou des armes empoisonnées, et le paragraphe 2 e 14 concernant à l'utilisation des gaz, des liquides des matières, ou des matériaux interdits, ainsi que le paragraphe 2 e 15 concernant l'utilisation de balles prohibées.

|f The study attempts the exposure of the amendments in the statute of the International Criminal Court, as well as the ordinance of criminal elements in accordance with article 123 of the statute of the International Criminal Court which states that the UN Secretary-general shall convene a review conference to consider any amendments to the statute after seven years of its commencement. This is what was done through the review conference in Kampala in June 2010 regarding the physical element of war crime, which is contained in resolution RC/Res.5 which resulted in the amendment of article 8 of the statute by adding paragraph 2 (e) of article 8, as well as the amendment of article 8 of the ordinance of criminal elements by adding paragraph 2 (e) (xiii) related to the use of poison or poisoned weapons and paragraph 2 (e) (xiv) related to the use of prohibited gases, liquids, materials or devices, as well as paragraph 2 (e) (xv) related to the use of prohibited bullets.\nThis abstract translated by Dar AlMandumah Inc. 2018
