يعد هذا البحث من الدراسات التي تظهر خطورة الجرائم الدولية المرتكبة ضد الإنسانية، والجهود الدولية المبذولة لضمان أعمال حقوق الإنسان وإنصاف الشعوب ووقف الممارسات اللاإنسانية ضد المدنيين أثناء الحروب. وتهدف الدراسة إلى استعراض أهم الجهود الدولية المبذولة الرامية إلى التعريف بجريمة الإبادة الجماعية وتجريمها والمعاقبة عليها، حيث لا تزال هذه الجريمة غير مجرمة وغير معاقب عليها في القوانين الوطنية للدول، وكذلك معرفة السبل الفعالة لمعالجة هذه الجريمة دوليا والمعاقبة عليها، ومنع وقوعها من قبل الدول في المستقبل. فالتعريف بخطورة هذه الجريمة وبيان أركانها كافة ليس كفيلا بمنع وقوعها، والسؤال الذي سنحاول الإجابة عليه هو: ما هي التدابير اللازمة والمأخوذة بعين الاعتبار دوليا لمكافحة هذه الجريمة والمعاقبة عليها؟ والفرضية التي يبنى عليها هذا البحث هو إثبات وقوع جريمة الإبادة الجماعية وممارستها بشكل واسع النطاق من قبل بعض الحكومات مع وجوب معاقبة مرتكبيها وفقا للقوانين الدولية وخصوصا في هذا السياق.
This research examines serious international crimes practiced against humanity and it also displays international efforts invested in assuring the realization of human rights, justice for people and the prevention of inhuman practices against civilians during wartimes. The study aims at reviewing the most important international efforts that aims at defining the crime of genocide and illustrating the prosecution and punishment of criminals. Until this day, the crime of genocide remains unpunished by national laws of the countries involved. In addition, this study pursues the effective methods needed to deal with this type of crime and how to develop these methods internationally. Furthermore, the study will move on to analyze the effective methods of punishment and prevention by future governments. Defining the crime of genocide and revealing its impacts are not enough to prevent this incident to take place in the future. Therefore, this research attempts to answer the following question: what are the international measures taken into account to prevent this crime from happening as well as to punish whoever responsible for it? The thesis of this research highlights the demonstration of the crime of genocide and how it is pursued—in a large scale—by some governments. Thus, it is significant to emphasize the necessity to punish whoever commits this crime by international laws.
