يتناول هذا البحث موقف الاتجاه الحداثي العربي، ورواد ما عرف بالمشاريع الجديدة لقراءة التراث الإسلامي، من الإمام الشافعي، ومنهجه الفكري، وطبيعة الانتقادات التي وجهوها إليه. ومقصد البحث الأساسي هو رصد أسباب الخصومة بين الاتجاه الحداثي وبين الشافعي؟ ولماذا اتسم موقفهم منه بالنقد الشديد، والهجوم المتشنج، والمصحوب بالعديد من الاتهامات التي طالت شخص الشافعي، وأسلوبه، ومقاصده، وتدينه، وأمانته العلمية، وآراءه العقدية، وما الذي قصده الحداثيون العرب من نقدهم لأصول الشافعي ومنهجيته وآرائه المتعلقة بالقرآن والسنة والإجماع والقياس، وكيفية فهم النصوص والتعامل معها. وقد بدأ البحث باستعراض موجز لمكانة الشافعي، وأبرز مناحي التميز في منهجه الفكري، ثم انتقل لبيان موقف الاتجاه الحداثي من الشافعي وأسباب هجومهم عليه، مع انتقاء أبرز القضايا المنهجية التي أثارت انتقاد الاتجاه الحداثي للشافعي، مثل موقفه من عربية القرآن، وتقرير حجية السنة والإجماع، ومكانة العقل والاجتهاد والقياس.
This paper addresses the modernist attitude and the view of the pioneers of the so-called neo-perusal projects directed towards Islamic heritage in the Arab world towards Imam Shafi’ie, his intellectual methodology, and the critiques addressing his literature. The primary purpose underlying this paper is to examine the causes of the modernists’ adversity towards Imam Shafi’ie; in particular, this study was inspired by the questions: why are Arab modernists characteristically over-critical in an overwrought and accusative way of Shafi’ie as regards the man’s personality, his style, goals, religiosity, academic integrity, and faith beliefs? What were the objectives of Arab modernists behind their critiques of Shafi’ie’s fundamental beliefs, methodologies, views of the Qur’an, the Sunna, and collective consensus of imams, logical reasoning, and the way of interpreting religious texts and Holy Scriptures and how they should be dealt with.The paper starts with an overview of the biographical data of Imam Shafi’ie and his position amongst early scholars of Islam, and the trends and features of his intellectual methodology. The researcher has dealt with the prominent methodological issues that inspired Arab modernists to criticize the Imam in more detail, especially his attitude towards the standard language of the Qur’an, his statement of the cogency of the Sunna and Ijma’a (consensual views of Islamic scholars) and the position of the intellect in ijtehad (deducting the Islamic rule from its sources) and qias (logical reasoning).
