520 |a The housing market in Saudi Arabia is currently characterised by an excess of demand over the housing supply. This is mainly due to the rapid rate of population growth in the country and the fact that a large proportion of the population is aged 30 or under, and is therefore looking to purchase a property. There is limited competition in the mortgage industry at the moment with the result that a relatively small proportion of the population have mortgages. However, Saudi Arabia’s recent accession to the World Trade Organisation (WTO), and the Saudi Arabian government’s desire to diversify the Saudi Arabian economy in order to reduce its vulnerability to economic volatility as a result of relying on oil revenues, has resulted in government policies which aim to increase the participation of the private sector. This has resulted in the drafting of a new series of mortgage laws which aim to improve the regulation of the mortgage sector. Despite the forthcoming legislation, the findings of this dissertation suggest that both the current and forthcoming pieces of mortgage legislation do not include effective protection of consumer rights. This dissertation examines the key challenges which exist to developing effective consumer protection legislation for ijaramortgages. The key challenges which are identified include problems with arriving at a comprehensive regulatory definition of ijaramortgages, the inadequate enforcement of legislation within the Saudi Arabian judicial system and the low levels of financial information which consumers in Saudi Arabia have about mortgage products.
