|a هدفت الدراسة إلى تسليط الضوء على حقوق الإنسان في الفكر الإسلامي والفكر الغربي المعاصر، وإبراز اهتمام المفكرين المسلمين والمعاصرين في مجال حقوق الإنسان، بغرض الوصول إلى صورة توفيقية تجمع أفضل ما في الفكرين تتمثل فيهما الأصالة والمعاصرة، وقد استخدم الباحث المنهج النظري مستعيناً بالوصف والتحليل، وخلص إلى أنّ النّظرة الإسلامية المعاصرة لحقوق الإنسان شاملة لجميع أنواع الحقوق؛ كحرية الاعتقاد والفكر، والعمل، والتعليم، وحق الحياة، والحرية الشخصية، وحماية الأموال والأعراض، وحقوق الأطفال، والمرأة، والمساواة أمام القانون، ومكافحة التمييز العنصري، كما أظهرت الدراسة بروز الأصالة والاستقلالية في الحقوق والحريات في الفكر الإسلامي والتوازن في التشريع، وأن أوجه التلاقي إسلامياً وعالمياً في مجال حقوق الإنسان قد برز في الإعلان الإسلامي لحقوق الإنسان عام (1990)، والذي جاء ليؤكد المساهمة في جهود البشر المتعلقة بحقوق الإنسان التي تهدف إلى حمايته من الاستغلال والاضطهاد، وتؤكد على حريته وحقه في الحياة الكريمة والتي تتفق مع الشريعة الإسلامية، مما يدلل على أنَّ كثيراً من هذه المبادئ كان لها جذور متأصلة في الفكر الإسلامي.

|b This study aimed at highlighting the human rights in the Islamic and the contemporary western thoughts, and clarifying the interest of the Islamic and the contemporary Western thinkers in this matter in order to get a reconciliation assembling the best of the two thoughts, since representing the originality and contemporaneous. The researcher used the descriptive analytical theoretical approach, The results showed that the Islamic and the contemporary perspectives comprehending all the rights such as: the freedom of thought and belief, work, learning, live, woman rights, equity in front of the law, and struggling the discrimination. The results also clarifying autonomy and originality in the rights and freedom in Islamic thought, and the equilibrium of legislation, Moreover, the similarities of the human rights in Islam and the West appear in the World Declaration for Human Rights in 1990, which emphasized the contribution in the efforts on this field that aimed at prevent the utilization and persecution, it also emphasized on human rights in freedom and good life which share with the Islamic Sharia (Law), which reveals that the most previous principles originate in the Islamic Thought, In the light of the results the researcher suggests some recommendations.
