رغم بذل الجهود الكبيرة من قبل المؤسسات الدولية العاملة في مجال حماية حقوق الإنسان إلا أن الانتهاكات في جميع أنحاء العالم مستمر وفي تزايد وهذا إن دلّ على شيء إنما يدل على عجز هذه المؤسسات من الحد من الانتهاكات، هذه الدراسة تبحث في مؤسسات جديدة تساهم مع المؤسسات الدولية في عملها بالحماية وذلك في إطار الشريعة الإسلامية بوصفه نظاما شاملا لكل ما يحتاجه الإنسان في حياته من النواحي السياسية، القانونية، الاجتماعية، الاقتصادية...الخ. نبحث في هذه الدراسة عن تحديد مفهوم حماية حقوق الإنسان في الشريعة الإسلامية ومقارنتها بمفهومها في القانون الدولي وبعدها نحاول تحديد المؤسسات العاملة في حماية حقوق الإنسان في ظل النظام الإسلامي ونأخذ منظمة التعاون الإسلامي نموذجاً كمؤسسة حكومية دولية تستطيع أن تلعب دوراً كبيرا في مجال الحماية الدولية لحقوق الإنسان وذلك باتباع منهج تحليلي للمؤسسات وللمنظمة ومقارن مع النظام الدولي لحماية حقوق الإنسان. وقد توصلنا إلى نتائج عدة نذكر منها أن نظام الحماية في القانون الدولي والشريعة الإسلامية يتضمن شقين أولهما نظري متمثل بالاعلانات والقواعد الخاصة بحماية حقوق الإنسان والثاني عملي متمثل بالمؤسسات التي تتشكل لتطبيق وتنفيذ هذه المبادئ. وهناك في النظام الإسلامي مؤسسات تستطيع أن تعمل في مجال الحماية الوطنية والدولية لحقوق الإنسان بالتعاون مع المؤسسات العاملة في الميدان في وقتنا الحاضر، كما أن منظمة التعاون الإسلامي لا تقل أهمية عن الأمم المتحدة إذا ما فعّلت مؤسساتها وأرادت أن تكون لها تأثير وأثر على حماية حقوق الإنسان. كما اقترحنا بعض المقترحات نذكر منها: توحيد الإعلانات الاسلامية الصادرة بشأن حقوق الإنسان في وثيقة واحدة على أن يتم هذا التوحيد في ظل منظمة التعاون الإسلامي. تفعيل عمل الهيئة المستقلة لحقوق الإنسان: وذلك من خلال فتح مكاتب مراقَبة ومتابَعة في جميع الدول الأعضاء في المنظمة وأن تكون لديها خبراء في مجال القانون الدولي وحقوق الإنسان وأن تؤسس لجنة تحقيقية دائمة للتحقيق في انتهاكات حقوق الإنسان.
Despite of the major efforts spent from the human rights main international institutions, the violation increasingly growing allover the world, this situation is such an improvement about the weakness of those institutions to limit violation against humanity. This study looking for create new institutions through Islamic system working in contribution with the international institutions in protecting human rights, starting with the conception of protecting human rights in the Islamic system comparing with the conception at international law, then determining the Islamic institutions of protecting human rights taking the IOC organization such an governmental international organization as a sample for having effective role to protect human rights, the study has taken analytical approach through the presentation and analysis the conceptions and Islamic institutions, and comparative approach comparable between the international law of human rights and Islamic system. The study reached to several conclusions, including the protecting system of human rights in both of international law and Islamic system has two part; theoretical through the rules and agreements and practical part by the institutions working to apply the principals of protection. In the Islamic system there are several institutions which can work on the field together with the international systems. Also the Islamic cooperation organization can be an effective tool to protect human rights. The study has some recommendations such as unifying the declarations and principles of human rights in Islam in one universal declaration sponsored by the IOC; activation the independent organism of human rights by opening observation offices at the member countries in the organization and establish a permanent investigation committee to investigate the abuses against human rights and it's important to have an international law and human rights law experts working in the field.
