|a تؤدي الآثار دورا مهما في حياة الشعوب والأمم؛ مما استلزم معه سن العديد من التشريعات الوطنية والاشتراك في العديد من المعاهد الدولية لحماية تلك الآثار باعتبارها جزءا من التراث الوطني والثقافة الإنسانية. وتأتي هذه الدراسة لبيان جوانب مختلفة تتعلق بموضوع الآثار، فيتناول المبحث الأول مفهوم الآثار من الناحية اللغوية والعلمية، ثم تتعرض لبيان أهمية علم الآثار من جوانب عدة، على سبيل المثال، الجوانب : السياسي والاقتصادي والقضائي، ثم تختم الدراسة مبحثها الأول ببيان أنواع هذه الآثار من خلال تأصيل أساس هذا التصنيف وبيان محتواه. وفي المبحث الثاني من هذه الدراسة، يتم تحليل نطاق الحماية القانونية الجزائية التي رسمها المشرع الكويتي من خلال المرسوم الأميري رقم (1) لسنة (1960) بشان قانون الآثار الكويتي، الصادر عن سمو الأمير الراحل عبدالله السالم الصباح، رحمه الله. وفي المطلب الأول ،تقف هذه الدراسة عند بيان الأنشطة أو السلوكيات الإنسانية المؤثمة من الناحية القانونية، التي من شأنها المساس بالآثار، في حين يخلص المطلب الثاني إلى تقييم السياسة التشريعية حيال الركن المعنوي للجريمة المتعلقة بالآثار والسياسة العقابية التي انتهجها المشرع الكويتي ومدى فاعليتها في تحقيق الردع أو حماية المتعلقات الأثرية.

|f Artefacts play an important role in the lives of peoples and nations, and as such they require the enactment of numerous national legislations and the participation in many international institutions for the protection of those artefacts, due to their consideration as being part of the national heritage and human culture. This study has come to explain the different aspects related to the subject area of artefacts. The first topic addresses the concept of artefacts from the linguistic and academic angle. It then goes on to explain the significance of knowledge of artefacts from numerous angles, including the following, for example: The political, economic and judicial angles. The study then concludes its first topic by explaining the types of artefacts by rooting the basis of this classification and explaining its content. In the second topic of this study, the scope of the legal protection set by the Kuwaiti legislature, by way of the number “1” Emiri decree (1960), in relation to the matter of the Kuwaiti artefacts law, issued by the late Amir Abdullah Al-Salem Al-Sabah, may God have mercy upon him, is analyzed. In the first topic, the study stops at explaining the criminal human activities and conducts, from a legal perspective, which encroach upon artefacts. That is whilst the second topic evaluates the legislative policy regarding the immaterial element of crime related to artefacts and the punitive policy pursued by the Kuwaiti legislature, in addition to the extent of its effectiveness in respect to realizing deterrence or protection in relation to the artefacts.\nThis abstract translated by Dar AlMandumah Inc 2018.
