|a تعتبر الكتابة وسيلة من وسائل التعبير الإنساني لأنها تحتوي على مضامين وأفكار ومفاهيم معينة قابلة للإدراك ويتم استخدام الكتابة في نطاق العقود للتعبير عن إرادة الأفراد وما اتجهت إليه، وتعد الكتابة من أهم وسائل الإثبات أضف إلى ذلك أن المشرع يتطلبها في بعض الأحيان ويجعل عدم وجودها من أسباب عدم انعقاد العقد، وعليه فإن للكتابة دورا كبيرا في انعقاد العقد عندما يكون شكلياً، ويتطلب المشرع الكتابة لانعقاده، والكتابة إما عادية أو الكترونية والثانية تتسم بأنها تتم على دعامة إلكترونية بواسطة جهاز الحاسب الآلي ودون ذلك فهي تتفق مع الأولى من حيث اعتبارها وسيلة للتعبير، وحمل الأفكار و المفاهيم القابلة للإدراك وقد ساوى المشرع بين الكتابة العادية والكتابة الإلكترونية فجعل الغرض متحققاً بالكتابة الإلكترونية كلما تطلب القانون الكتابة واشترطها بغض النظر عن غاية اشتراطه إياها أو أثرها في التصرف القانوني.
